Statutes — 6, 7 and 15

Suspension
Whether an order of suspension can be passed against an employee of Bangladesh
University of Engineering and Technology until and unless a formal charge-
sheet under statute 7 is served upon the delinquent employee — From the
language of clause (2) of statute 15 it cannot be said that the authority is
precluded from passing an order of suspension unless and until a formal charge
sheet under statute 7 is served upon a delinquent employee — Clause(2) of
statute 15 applies when the “conduct of a delinquent employee is under
investigation of a charge’ — — In the statutes care has been taken to describe
a formal charge as a “charge sheet” — The stage to suspend a delinquent
employee arises when the authority has taken a decision that the allegations,
if established, would entail a penalty of dismissal or removal from service —
The authority may arrive at that decision with or without making a preliminary
investigation under clause(2) of statute (6) — But once the authority takes
this decision, its power to suspend is attracted under clause(2) of statute 15 —
This power is not dependent upon the framing and service of charge-sheet under
statute 7.
