Regulations 12&13—

Non
existence of Managing Committee of the school does not vest the Deputy
Commissioner (ex—officio chairman of such Committee) with the power to suspend
a teacher of the school.

Regulation 14—

As there is
no provision imposing a legal obligation on a member of the enquiry committee
to be present in all its sittings, no legal consequence will follow from a
member’s failure to attend such a sitting. There is no mandatory provision in
the Regulations that in the absence of a member of the enquiry committee its
meeting is to be adjourned.

Regulation 6—

It is the
essence of the concept of probation that a person is on trial regarding his
suitability for regular appointment and is liable to be discharged when proved
unsuitable.

The proposal
for dismissing the petitioner was passed before its approval by the Board and,
as such, the order of dismissal appears to have been passed in flagrant contravention
of the proviso to Regulation 12 of the Regulations.

Regulation 12—

The proviso
to Regulation 12 does not contemplate any post facto approval of an order of
dismissal by the Board, rather it provides that such approval should be secured
before passing the order of dismissal of service of a teacher.

The proviso

Regulation 7(2)—

There is no
provision in the Regulation that a Managing Committee after being elected has
to be approved by the Board, although the member—secretary is required to
inform the Board about the constitution of the new Managing Committee.
