Departmental proceedings—Whether
enquiry done by an officer not appointed by the authority having the power to
dismiss the employee vitiates proceeding — The report of the, Enquiry Officer
was forwarded to the Managing Directors and the Central Board of Director of
the Bank after examining the report dismissed the plaintiff — Findings of the
District Judge that the departmental proceeding and appointment of Enquiry
Officer were not made by the Central Board of directors and his judgment and
decree based thereon cannot be maintained—Bangladesh Bank (Na-aonalisation)
Order. 1972 (P.O. 26 of 1972), Art. 10.
