Trade Marks
Rules

Rules 30-35—[See in
the case of Crescent Pak. Soap and Oil Mills Vs. Deputy Registrar of Trade
Marks. in 17 DLR (SC)163 above.]

Rule 76—Registrar
of Trade Marks has got authority to grant an extension of time under rule 76 of
the Trade Marks Rules. Crescent Pak. Soap and Oil Mills Vs. Deputy Registrar of
Trade Marks, in 17 DLR (SC)163 above.]

—No express
order of extension of time necessary.

There is
nothing in rule 76 to indicate that an express order is necessary for extending
the time. The mere fact, therefore, that the opposition was admitted after the
lapse of the prescribed time and served upon the applicant by the Registrar
himself indicates that the Registrar condoned the delay.
