Principle of Natural Justice—If not followed—Effect of—With regard to the question of maintainability of the Writ Petition, we hold that it is maintainable inasmuch as the service of the petitioner having not been commenced she cannot be treated as a public servant prior to her joining at the school. It is a settled principle that no one should be punished without providing him/her any opportunity of being heard. In the instant case the principles of “audi alteram partem” has not been adhered to by the respondents. On this score the impugned order of cancellation of the appointment of the petitioner should be knocked down. The respondents are directed to accord permission to the petitioner to join her post as an Assistant Teacher in the designated school within a period of 30(thirty) days from the date of receipt of a copy of this judgment....(7 and 11)

1. On an application under Article 102 of the Constitution, the Rule Nisi was issued calling upon the respondents to show cause as to why the impugned Memo No. ­জপ্রাশিঅ/ পটুয়া/১৪৫৯ dated 22.07.2009 issued by the respondent no. 4, District Primary Education Officer, Patuakhali cancelling the appointment of the petitioner from the post of Assistant Teacher of Dakkhin Konokdia Government Primary School, Bauphal, Patuakhali (as contained in Annexure-‘D’ to the Writ Petition) should not be declared to be without lawful authority and of no legal effect and/or such other or further order or orders passed as to this Court may seem fit and proper.

The short facts for the purpose of disposal of the Rule as stated in the Writ Petition, are that the respondent no. 2 being the Director General of Primary Education published an advertisement in the National Daily Newspaper (Prothom Alo) on 06.02.2008 inviting applications for appointment of Assistant Teachers for Government Primary School throughout the country. The petitioner applied for appearing in the examination wherein admit card no.7465 was issued in her name. On finding her qualified in both the written and the viva voce examinations the respondent no. 4 on 26.04.2009 issued an appointment letter in her favour with a direction to join as an Assistant Teacher in Keshabpur N. S. Government Primary School, Bauphal, Patuakhali. Subsequently the office of the respondent no. 4 issued an amended letter of appointment on 25.05.2009 directing the petitioner to join at Dakkhin Konokdia Government Primary School, Bauphal, Patuakhali as an Assistant Teacher [Annexure-‘C(2)’ to the Writ Petition]. In compliance with the amended letter of appointment the petitioner went to the designated school on 20.05.2009 for joining to the selected post but without assigning any reason her joining was not accepted by the respondents. Thereafter the petitioner came to know that her appointment had been cancelled by the respondent no. 4 and that an office order dated 22.07.2009 was issued to that effect. Challenging the said decision of cancellation of the appointment the petitioner moved this Court invoking the writ jurisdiction. During the pendency of the Rule issued in Writ Petition No. 7090 of 2009 it was conveyed to the petitioner that in the event she withdrew the Writ Petition her case would be considered by the respondents. Accordingly the Rule issued in Writ Petition No. 7090 of 2009 was discharged for non-prosecution at the instance of the petitioner. The petitioner approached the respondents on several occasions to take initiative for her joining and lastly when they failed to do so on 05.05.2015 she served a notice demanding justice requesting the respondents to accept her joining but the same yielded no result. The petitioner eventually moved this Court and obtained the Rule as stated above.

Mr. Golam Mohiuddin, learned Advocate appearing for the petitioner, submits that although the petitioner was appointed as an Assistant Teacher through a transparent appointment process, her joining was not accepted illegally. The learned Advocate submits further that the impugned order of cancellation of the appointment was issued without giving any notice to the petitioner and providing her any opportunity of being heard which is violative of the principle of natural justice. The learned Advocate lastly submits that the petitioner was not dismissed, removed or suspended from the post of Assistant Teacher of the Government Primary School but her very appointment was cancelled illegally and thus the Writ Petition is maintainable inasmuch as the action of the authorities was malafide which is violative of the fundamental rights of the petitioner.
 
4. The Rule is not opposed.
 
5. We have heard the submissions of the learned Advocate for the petitioner and perused the writ petition, the supplementary affidavits including the annexures thereto.
 
6. Admittedly the petitioner appeared in the written and viva voce examinations and having been qualified was appointed on 26.04.2009 as an Assistant Teacher at Keshabpur N. S. Government Primary School, Bauphal, Patuakhali. Subsequently her appointment order was amended and she was asked to join at Dakkhin Konokdia Government Primary School, Bauphal, Patuakhali. On the basis of the amended appointment letter dated 20.05.2009 the petitioner wrote a letter to the respondent no. 4, District Primary Education Officer, Patuakhali seeking permission to join the school (Annexure-‘J’ to the Supplementary Affidavit dated 29.11.2015); but the District Primary Education Officer did not accord her permission to join in the school and kept silent till the issuance of the order of cancellation of appointment. After about two months, the petitioner received the impugned letter dated  22.07.2009 and came to know that her appointment had been cancelled on the basis of a decision dated 22.06.2009 taken by the Director (policy and operation) on behalf of the Director General of Primary Education Directorate, Dhaka. The order of cancellation of the appointment of the petitioner was issued on the allegation that the authority had found dissimilarity between the signature of the petitioner made in the application for seeking appointment and the other one in her joining letter dated 20.05.2005 (as contained in Annexures-‘J’ and ‘K’ respectively). In the advertisement for appointment of teachers a condition, among others, has been set out to the effect that the application could not be accepted if it was not written by the concerned candidate. An application for seeking appointment of teacher can be rejected at any time without prior notice even after appointment if it has been filed containing false and fabricated information and papers. In the instant case, no such allegation had been brought against the petitioner to the effect that she had provided false information or submitted false documents at any point of time. There is in fact no dispute that the petitioner was appointed as an Assistant Teacher in a Government Primary School through a competitive examination. It appears from the appointment letter dated 26.04.2009 that the petitioner and other teachers were appointed temporarily for 2 (two) years under certain terms and conditions. Those conditions are reproduced below:

২।   নি­য়া­গর শর্তাবলী নিম্নরূপঃ
(ক) যোগদা­নর তারিখ থে­ক ২ (দুই) বৎস­রর চাকুরীকাল শিক্ষানবীশ কাল হিসা­ব গণ্য হ­বে।
(খ) শিক্ষানবীশ কা­ল কর্মদক্ষতা, আচরন ও স­ন্তোষজনক চাকুরীর রেকর্ড সা­প­ক্ষ চাকুরী স্থায়ীকর­নর বিষয় বি­বচনা করা হ­ব এবং শিক্ষানবীশকা­ল যে কোন ধর­নর অসদাচর­নর জন্য কোন কারন দর্শা­না ব্যতি­র­কই চাকুরীচ্যুত করা যা­ব।
(গ) নি­য়াগপ্রাপ্ত শিক্ষক/শিক্ষিকার পুলিশী তদ­ন্তর সন্তোষজনক রি­পার্ট পাওয়া না গে­ল চাকুরীচ্যুত করা যা­বে।
(ঘ) প্রশিক্ষণবিহীন প্রার্থীগণ­ক নি­য়াগ আ­দশ প্রাপ্তির তারিখ থে­ক পরবর্তী ৩(তিন) বৎস­রর ম­ধ্য সি-ইন-এন্ড প্রশিক্ষণ গ্রহন কর­ত হ­ব।
(ঙ) নি­য়াগপ্রাপ্ত শিক্ষক/শিক্ষিকা কর্তৃক যে কোন সম­য় সরবরাহকৃত যে কোন তথ্য ও সনদপত্র মিথ্যা/ভূয়া/ত্র্রটিপূর্ণ প্রমানিত হ­ল নি­য়াগ আ­দশ বাতিল করা যা­ব এবং প্রচলিত আই­নর বিধান অনুযায়ী তার বিরু­দ্ধ ব্যবস্থা গ্রহন করা হ­বে।
(চ) সরকারী প্রাথমিক বিদ্যালয় শিক্ষক নি­য়াগ বিধিমালা ১৯৯১ এর ৭(১)(খ) ধারায় নি­য়াগপ্রাপ্ত প্রার্থী যে উপ­জলা বা জেলায় আ­বদন ক­র­ছন সে উপ­জলা বা জেলা ব্যতীত ভিন্ন উপ­জলা বা জেলায় নির্বাচিত হ­ল নির্বাচিত উপ­জলা বা জেলায় চাকুরী কর­ত ইচ্ছুক হ­লই কেবল নি­য়াগকৃত প­দ যোগদান কর­বন, অন্যথায় তার যোগদান করার প্র­য়াজন নেই।
৩) নির্বাচিত প্রার্থী­দর আগামী ২৫ মে, ২০০৯ তারি­খর ম­ধ্য যোগদান কর­ত হ­বে। এ সম­য়র ম­ধ্য যোগদান কর­ত ব্যর্থ হ­ল তার/তা­দর নি­য়াগ আ­দশ বাতিল ব­ল গণ্য হ­বে।
৪)    সংশ্লিষ্ট বিদ্যাল­য় যোগদা­নর পূ­র্ব প্র­ত্যক প্রার্থী সংশ্লিষ্ট জেলা প্রাথমিক শিক্ষা অফিসার বরাবর যোগদা­নর অনুমতির জন্য আ­বদন ক­র যোগদা­নর অনুমতি পত্র গ্রহন কর­বেন। যোগদা­নর অনুমতি পাওয়ার পর সিভিল সার্জন কর্তৃক প্রদত্ত সনদ, দুই কপি যোগদান পত্র ও অন্যান্য সন­দর সত্যায়িত কপি সংশ্লিষ্ট উপ­জলা/থানা শিক্ষা অফিসা­রর কার্যাল­য় দাখিল করতঃ এতদসংক্রান্ত একটি প্রত্যয়নপত্র গ্রহণ ক­র সংশ্লিষ্ট বিদ্যাল­য় যোগদান কর­বেন। উপ­জলা শিক্ষা অফিসা­রর কার্যাল­য় যোগদা­নর তারিখই শিক্ষ­কর চাকুরী­ত যোগদা­নর তারিখ হি­স­ব গণ্য হ­বে।
৫)   নি­য়াগকৃত শিক্ষক­দর বেতন ভাতাদি কোড নং ৫-২৪৩১-৫০০০-৪৬০০/৪৭০০ এর বেতন ভাতাদি খাত থে­ক মিটা­না হ­বে।
৬)   প্রাথমিক শিক্ষা অধিদপ্ত­রর বিজ্ঞপ্তি নং প্রাশিঅ/ নি­য়াগ/সঃশিঃনিঃ/০১/০৮/২৯, তারিখ ০৫/০২/০৮ অনুসা­র এ নি­য়াগ প্রদান করা হ­লো।

7. On a perusal of the aforesaid conditions, it appears that the petitioner has not violated any of the terms and conditions mentioned therein. With regard to the question of maintainability of the Writ Petition, we hold that it is maintainable inasmuch as the service of the petitioner having not been commenced she cannot be treated as a public servant prior to her joining at the school. It is a settled principle that no one should be punished without providing him/her any opportunity of being heard. In the instant case the principles of “audi alteram partem” has not been adhered to by the respondents. On this score the impugned order of cancellation of the appointment of the petitioner should be knocked down.
 
8. In view of what have been stated above, we find merit in the Rule.  The Rule, therefore, succeeds.
 
9. Accordingly, the Rule is made absolute.
 
10. The impugned Memo No. ­জপ্রাশিঅ/ পটুয়া/১৪৫৯ dated 22.07.2009 issued by the respondent no. 4 cancelling the appointment of the petitioner from the post of Assistant Teacher of Dakkhin Konokdia Government Primary School, Bauphal, Patuakhali is declared illegal and the same have been passed without lawful authority and of no legal effect.
 
11. The respondents are directed to accord permission to the petitioner to join her post as an Assistant Teacher in the designated school within a period of 30(thirty) days from the date of receipt of a copy of this judgment.
 
12. The office is directed to send a copy of this judgment and order to each of the respondents at once for compliance.
