In the matter of the Will dated . . . . . . . . . of Shri B.C., son of . . . . . . . . . . . . . . . . , resident of . . . . . . . . . deceased.

Affidavit

I, C.D, . . . . . . . . make oath (or solemnly affirm) and say as follows:

1. That I knew and was well acquainted with Shri B.C. the late of. . . . . . . . . . . . , the said deceased.

2. That on the 5th day of June, 1939, I was present together with D.F., resident of . . . . . . . . . . . . , at the house of the said deceased in the city of. . . . . . . . . . . .and we did then and there see the said deceased sign and execute the will in the Hindi language and character hereunto annexed and marked with the letter. . . . . .  and declare and publish the same as and to be his last will and testament.

3. That thereupon I, the deponent and the said D.F. did at the request of the aforesaid deceased and in his presence and in the presence of each other all being present at the same time, set and subscribed our signatures to the said will as witnesses thereto.

4. That the signature of B.C. at the foot of the will and on the margin of pages 1 and 2 and the interlineations on line 4 of page 1 and line 3 of page 3 of the said will, as of the deponent and the said D. F. are in proper respective handwritings of the testator and the witnesses attestings the said document.

5. That at the time the said deceased executed the said will he was of sound and disposing mind, memory and understanding and to the best of my belief made and published the same of his free will and pleasure.

6. That this my affidavit is true, that it conceals nothing and no part of it is false.
