BANGLADESH TECHNICAL EDUCATION BOARD ACT, 20

Legislation created to repeal the Technical Education Act, 1967

As it is expedient and necessary to enact new legislation by repeating the Technical Education Act, 1967 (Act No. 1 of 1967);

Therefore, the law is hereby made as follows: –

The first chapter is

introductory

Short title and introduction

  1. (3) This Act shall be called Bangladesh Technical Education Board Act, 20.

(2) It shall be effective immediately.

Definition

  1. Unless there is anything repugnant in the subject or context, in this Act-

(1) “Technical and Vocational Education and Training” means the technical and vocational education and training referred to in Schedule 1;

(2) “Chairman” means the Chairman of the Board;

(4) “National Technical and Vocational Qualification Framework” means the National Technical and Vocational Qualification Framework referred to in Schedule II;

(4) “National Skill Development Authority” means the National Skill Development Authority established under the National Skills Development Authority Act, 20 (Act No. 2 of 24);

(4) “Fund” means a Fund constituted under section 4;

(4) “Schedule” means any application of this Act;

(3) “Board of Directors” means the Board of Directors constituted under section 4;

(3) “Recognition of Prior Learning” means the recognition of previous learning of any education, skill or knowledge acquired in a formal or informal manner;

(4) “Regulation” means the regulations made under this Act;

(4) “Rule” means the rules made under this Act;

(4) “Board” means the Bangladesh Technical Education Board established under section 4;

(12) “Secretary” means the Secretary of the Board; And

(3) “Competency Based Training and Assessment” means the training and evaluation undertaken to achieve the national technical and vocational qualification framework.

Chapter II

Establishment of the Board, et al

Establishment of the Board

  1. (4) With the implementation of this Act, for the purpose of this Act, a Board named Bangladesh Technical Education Board shall be established.

(2) The Board shall be a statutory body and shall have a permanent continuity and a common seal and shall have the power to acquire, hold and transfer the immovable and immovable property of both immovable and immovable property, subject to this Act and the rules made thereunder. Office of the Board

  1. The Head Office of the Board shall be in Dhaka and the Board may establish its regional and branch offices at any place in Bangladesh, with the prior approval of the Government.

Management and administration

  1. The responsibility of the management and administration of the Board shall be vested in the Board of Directors, and the Board may exercise and exercise any such powers as the Board may exercise.

Board of directors

  1. (3) The Board of Directors shall consist of the following members, namely: –

(a) the Chairman, who shall also be its President;

(B) a representative of the rank of his other Deputy Secretary nominated by the Technical and Madrasah Education Department;

(C) a representative of the rank of his other Deputy Secretary nominated by the Secondary and Higher Education Department;

(D) a representative of the rank of Director, designated by the Directorate of Technical Education;

(E) a representative of the rank of its director, nominated by the National Skill Development Authority;

(F) a representative of the rank of its director, nominated by the Department of Agriculture Extension;

(G) a representative of the rank of its director appointed by the Bureau of Manpower Employment and Training;

(H) a representative of the rank of Director, designated by the Department of Textiles;

(I) a representative of the Board of Directors nominated by the Bangladesh Computer Council;

(J) a representative of the rank of its Director, nominated by the Bangladesh Industrial Technical Support Center;

(K) the Vice-Chancellor, one of its professors nominated by the Bangladesh University of Engineering;

(L) a Vice-Chancellor, one of its Professors nominated by the University of Dhaka Engineering and Technology;

(E) Principal, Dhaka Polytechnic Institute, Dhaka;

(1) a principal of the Government Technical School and College designated by the Government;

(O) a representative of the Federation of Bangladesh Chambers of Commerce and Industries;

(T) a principal of a private technical education institute nominated by the Government;

(L) a representative of the Industrial Skills Council nominated by the National Skill Development Authority;

(D) a representative of the rank of executive member nominated by the Federation of Bangladesh Employers;

(B) three (three) representatives of the specialist level of technical and vocational education nominated by the Government, of which one shall be female; And

(n) the Secretary, who shall also be its Member-Secretary.

(2) The members nominated under clauses (1), (t) and (d) of sub-section (1) shall

remain in office for a period of three (three) years from the date of their nomination: provided that the Government, for any reason, Except as

indicated, a nominee may cancel his nomination before the expiry of his term: Further, a nominee may, at any time, resign his post with the intention of writing to the chairman, in his signed letter. Get out.

Meeting of the Board of Directors

  1. (4) Subject to the other provisions of this section, the Board of Directors may determine the procedures of its meetings.

(2) The meetings of the board of directors shall be convened by the member-secretary, with the consent of its chairman, and shall be held at the place and time appointed by the chairman.

(3) A meeting of the Board of Directors shall be held at intervals of every three (three) months, but the Board of Directors may convene, if necessary.

(3) The Chairman shall preside over all meetings of the Board of Directors, and in his absence, a member elected from among the members present at the meeting shall preside over the meetings of the Board of Directors.

(3) The quorum of the meeting of the Board of Directors shall require the presence of at least one-third of the members, but in case of adjournment meetings, no quorum shall be required.

(3) Each member of the Board of Directors shall have one vote and the majority of the members present shall decide the meeting, and in the case of equality of votes, the person presiding at the meeting shall have the power to cast a second and decisive vote.

(4) Only a vacancy in the membership of a member or the formation of a Board of Directors shall not invalidate any function or function of the Board of Directors and no question shall be raised in connection with it.

Duties and Functions of the Board

  1. The duties and functions of the Board shall be as follows: –

(a) Management, recognition and control of technical and vocational education and training;

(B) to determine the technical and vocational education and training courses covered by this Act, and to prepare curricula for such courses and to formulate curriculum;

(C) to produce textbooks and educational materials in accordance with the curriculum made by the Board;

(D) to take technical and vocational education and training tests, check competencies, determine fees, publish results and issue certificates;

(E) to formulate policies regarding student recruitment and inter-institution student transfer in the institutes of technical and vocational education and training recognized by the Board;

(F) to inspect, supervise and monitor the institutions providing technical and vocational education and training recognized by the Board;

(G) recognizing prior experience in the scope of this Act;

(H) Establish and maintain information management procedures for technical and vocational education and training institutions recognized by the Board;

(I) to collect information on technical and vocational education and training needs through the Industrial Skills Council;

(J) to prepare competency-based training and evaluation courses in collaboration with the Industrial Skills Council;

(K) to set eligibility criteria under the National Technical and Vocational Qualification Framework;

(L) awarding a scholarship, medal or award for technical and vocational education and training;

(D) to execute a contract with an agency for the purpose of this Act:

Provided that the government’s approval must be obtained in the case of contracting with a foreign company; And

(3) To perform any other duty as may be prescribed by the Government.

Recognition of technical and vocational education and training, etc.

  1. (3) The Board shall grant technical and vocational education and training accreditation:

Provided that the approval of the Government in respect of the technical and vocational education and training accredited under this Act shall be obtained by an institution located abroad.

(2) The procedure for granting the recognition referred to in sub-section (1), the fee, the suspension or cancellation of the acceptance, the appeal against the suspension or cancellation of the recognition and all other matters shall be determined by the rules.

Inspection

  1. (3) A person empowered by the Board may inspect any examination or competency test conducted by an institution or by him who is providing technical and vocational education and training.

(2) The inspector shall notify the inspection report board conducted under sub-section (1).

(3) The Board shall take necessary action in the context of the inspection report under sub-section (2).

Accountability

  1. (3) The Board shall be responsible to the Government for its functions.

(2) The Government shall have the power to inspect or investigate any matter relating to the Board.

(3) In the case of an inspection or inquiry report held under sub-section (2), the Government may provide necessary directions to the Board and if any such instruction is provided, the Board shall comply with it.

(3) The Government may, in the public interest, terminate any activities or committees of the Board by written order:

however, before giving such an order, the Government shall summon the Board or the concerned committee to show the reason why such order shall not be granted. .

Appointment of chairman and his powers and responsibilities

  1. (3) There shall be a Chairman of the Board.

(2) The Chairman shall be appointed by the Government and the terms and conditions of his service shall be fixed by the Government.

(3) The Chairman shall be the Chief Executive of the Board and he shall –

(a) take appropriate steps to implement the functions and decisions of the Board;

(B) preserve the accounts of the Board, prepare accounting statements and conduct audits; And

(d) perform such other duties as may be assigned by the Government.

(3) For the purposes of this Act, the Chairman may, if necessary, take any activities:

but provided that such activities shall be presented to the first meeting of the Board of Directors to be approved thereafter.

(4) The Chairman may, on the basis of daily wages, temporarily appoint a laborer for a fixed term by the Board, in order to perform the functions of the Board.

(4) If the chairman becomes vacant or if the chairman is unable to perform his duties due to absence, illness or any other reason, the person appointed by the government is temporarily the chairman until the newly appointed chairman joins his post or the chairman is able to resume his duties. Secretary

  1. (3) There shall be a Secretary to the Board, who shall be appointed from among the employees of the rank of Deputy Secretary of the Government.

(2) The Secretary shall be a full-time employee of the Board and shall, according to the direction of the Chairman, determine the date, time and schedule of the meeting of the Board, prepare the meeting schedule, preserve the details of the work performed by the Board and other related duties and functions as prescribed by the Board.

Employee recruitment, etc.

  1. (3) The Board may, in order to perform its functions, appoint the required number of employees in accordance with the organizational structure approved by the Government.

(2) The terms of employment and employment of employees shall be determined by the regulations.

Formation of committees

  1. (3) For the purposes of this Act, the Board may constitute a number of committees as required.

(2) Notwithstanding the totality of sub-section (1), the Board shall have the following committees, namely: –

(a) Diploma Courses of Study Committee;

(B) the Certificate Courses of Study Committee;

(C) finance committee;

(D) the Regulation Committee;

(E) the selection committee;

(F) the Appeals and Arbitration Committee;

(G) the examination or competency verification committee;

(H) the Age Purification Committee;

(I) Equality Program Committee;

(J) the accreditation or accreditation committee;

(K) Equity Advisory Committee;

(L) Disciplinary Committee; And

(w) the research committee.

(2) The duties and functions of the Committee constituted under sub-sections (1) and (2) shall be determined by the Board.

Appointment of consultants

  1. (4) For the purpose of this Act, the Board may appoint, if necessary, a consultant or expert to perform any such work as it requires special knowledge and expertise.

(2) The duties of the expert and consultant and the terms and conditions of their appointment shall be determined by the Board.

Chapter Three is

Financial Issues

Funding

  1. (3) The Board shall have a fund and shall collect from the following sources, namely: –

(a) a grant from the Government;

(B) donations made by a person or organization;

(C) money received under this Act;

(D) the income earned from the investment;

(E) interest from money received in the bank; And

(f) money from any other legitimate source.

(2) The funding of the fund shall be deposited in the name of the board in a scheduled bank upon approval of the Board of Directors, and the funds may be withdrawn from the fund in the manner prescribed by the board.

(3) The functions of the Board under this Act shall be executed from the fund of all salaries, allowances and ancillary expenses of the employees, including the Chairman, Secretary.

Explanation.- The “Scheduled Bank” referred to in this section means Scheduled Bank as defined in Articale (2) (j) of Bangladesh Bank Order, 1972 (PO 127 of 1972).

Budget

  1. The Board shall, within the time prescribed by the Government, submit a budget statement for the approval of the Government, specifying the probable income and expenditure of each fiscal year and the amount of money required from the Government in that fiscal year.

Accounting and Auditing

(৩) উপ-ধারা (২) এ উল্লিখিত হিসাব নিরীক্ষা প্রতিবেদনের উপর কোনো আপত্তি উত্থাপিত হইলে উহা নিষ্পত্তির জন্য বোর্ড অবিলম্বে যথাযথ ব্যবস্থা গ্রহণ করিবে।

(1) In addition to the audits referred to in sub-section (2), the Board may be audited by a Chartered Accountant as defined in Article 2 (1) (b) of Bangladesh Chartered Accountants Order, 1973 (President’s Order No. 2 of 1973). And for this purpose the Board may appoint one or more Chartered Accountants, and such appointed Chartered Accountants shall be entitled to a reward at the rate prescribed by the Board of Directors.

(4) All records, records, annual balance sheets, cash or bank deposits, cash, bonds, deposits, deposits, cash, bank deposits, or any person authorized by the Auditor General or sub-section (1), for the purpose of auditing the Board, or any person empowered for such purpose. Annual Report

  1. (3) The Board shall, at the end of each financial year, submit to the Government an annual report containing the details of the activities performed in that year by July 1.

(2) The Government may, from time to time, from the Board, at any time, review any particulars, accounts, statistics and information relating to any matter under the control of the Board or report on any such matter, and the Board shall be obliged to send it to the Government.

Chapter Four

Terms and Conditions of Service

General terms of service for teachers and trainers of technical and vocational education and training institutes

  1. To fulfill the purpose of this Act, it may make regulations regarding the terms and conditions of employment of teachers and trainers of technical and vocational education and training institutions recognized by the Board.

miscellaneous

Public servant

  1. The Chairman, the Secretary and the employees of the Board shall be deemed to be public servants in the sense defined in Section 21 of the Penal Code, 1860 (Act No. XLV of 1860).

Retirement age

  1. Regardless of any other law for the time being in force, the retirement age of the permanent employees of the Board shall be five (sixty) years.

Handing over power

  1. The Board may, if necessary, delegate any of its powers under this Act to the Chairman, Secretary or any employee, subject to the conditions stated in the order, by general or special order in writing.

Determine the type, term, standard and qualification certificate of the technical and vocational education and training courses

  1. For the purpose of this Act, the type, term, standard and qualification of technical and vocational education and training courses shall be in accordance with the Schedule 5.

Ability to amend the schedule

  1. The Government may, on the recommendation of the Board, amend the schedule by notification in the Official Gazette.

Ability to make rules

  1. For the purpose of this Act, the Government may, by notification in the Official Gazette, make rules.

Ability to make regulations

  1. (3) For the purpose of this Act, the Board may, with the prior approval of the Government, make rules, by notification in the Official Gazette, subject to compliance with this Act and the rules made thereunder.

(2) The Board may, among other things, make regulations on all or any of the following, in particular and without undermining the totality of the powers conferred in sub-section (1); Namely: –

(a) to determine the eligibility of participation in technical and vocational education and training tests and competency verification, certification and withdrawal;

(B) Determination of fees for technical and vocational education and training tests and competency verification;

(C) to prepare technical and vocational education and training courses and courses;

(D) the method of acknowledging prior experience;

(E) conduct all tests and competency checks of the Board;

(F) the powers and responsibilities of the employees of the Board;

(G) Conduct Board and Committee meetings;

(H) the rules relating to the management of technical and vocational education and training institutions;

(I) the terms and conditions of employment of teachers and trainers of the institutes providing technical and vocational education and training;

(J) provision for resolving disputes between teachers, trainers and management boards of institutions providing technical and vocational education and training;

(K) the manner and type of inspection;

(L) the employment regulations of the employees of the board; And

(e) the travel and respect of the members to attend board and committee meetings.

Cancellation and custody

  1. (3) With the coming into force of this Act, the Technical Education Act, 1967 (Act No. 1 of 1967), hereinafter referred to as the Act, shall be repealed.

(2) Notwithstanding the repeal under sub-section (1) –

(a) the Board constituted under this Act shall be deemed to be a Board constituted under this Act, unless the Board constituted under that Act, hereinafter referred to as the Board;

(B) any acts, acts, rules, regulations, any acknowledgments or certificates issued, any orders, notices, notices or notices issued, any action taken or any proposed action made, made, given, issued under this Act. Shall be deemed to have been accepted or notified.

(4) With the repeal of the Act, the Board established under the Act shall:

(A) all immovable and immovable properties, cash and bank deposits and funds, investment of money, all other claims or rights, privileges received, all such rights, merits and interests and all rights arising out of it, including all accounts, register , The record sheet and all other related documents shall be vested and transferred to the Board;

(B) all debts, liabilities and obligations and agreements made by him or her, the debts, liabilities and obligations of the Board and the contract performed by him or with him shall be deemed to be;

(C) All employees shall be employees of the Board and shall continue to serve on the same conditions until the date of the change of the conditions under which they were employed prior to the commencement of this Act;

(D) any lawsuit or legal proceeding filed against or on behalf of the Board shall be deemed to be a case or legal proceeding filed against or on behalf of the Board.

  1. (3) After the enactment of this Act, the Government shall, by notification in the Official Gazette, publish an Authentic English Text translated into English of the original Bengali text of this Act.

(2) In the case of a dispute between the Bengali and the English text, the Bengali text shall prevail.
