Under
section 74 of the Bengal Local Self-Government Act, 1885, properties such as
road, bridge, channel, building etc, were placed at the disposal of the
District Board for their control and administration. After coming into
operation of Section 4 of the Basic Democracies Order, 1959, the Bengal Local
Self-Government Act was repealed and according to section 66 of the Basic
Democracies Order, 1959, and Rule 3 of the District Council (Property) Rules, 1960,
these properties were placed under the control and administration of the
District Council which holds these on behalf of the Government as its agent
without acquiring any right, title and interest therein.
