Without giving any Opportunity of haring

We could not find any authority in support of the action taken by respondent 3, the Additional Deputy Commissioner(Revenue) retiring the headmaster and asking him to hand Over the charge of the office. He may be the ex-officio Chairman of the managing committee. But he has got no power to direct the Headmaster either to retire or ask to hand over charge independent of the managing committee, it is on record that the managing committee considered the long devoted service of the headmaster to the school in three meetings in his presence and in the last meeting when the resolution extending the service was adopted he did not attend. He cannot supersede the resolution of such managing committee by executive fiat. His action smacks of bureaucratic mindset, which cannot he endorsed.
