Admittedly the writ petitioner was initially served with an order of suspension pending enquiry but instead of holding any enquiry pursuant to Ride 9 for disciplinary action, the petitioners proceeded with the respondent no. I on the basis of a enquiry
report dated 09.10. 1995 (Annexure-3) and passed the impugned order compulsorily retiring him from service. The said impugned order has been passed without complying with the provision of rules of the petitioners and in violation of principle of natural justice.
