Codicil substituting one Trustee for Another

I, A. B. etc. declare this to be the first codicil to my Will dated the . . . . . . . . . day of . . . . . . . . ., 20 . . . . . . . . .

WHEREAS by my Will I have appointed C. D. as one of the executors and trustees and have given him a legacy of Rs. . . . . . . . . if he acts.

AND WHEREAS the said C. D. has died.

1. Now I hereby revoke the appointment of the said C. D. as one of the executors and trustees of my Will and appoint K. L. etc. to be the executor and trustee thereof in place of the said C. D. and I bequeath to the said K. L. a legacy of Rs. . . . . . . . . . if he acts as such executor and trustee.

2. I hereby revoke the legacy of Rs. . . . . . . . . . given to the said C. D. by the said Will.

3. I hereby declare that my said Will and all the provisions contained therein shall be construed and take effect as if the name of the said K. L. were substituted therein as an executor and trustee thereof for the name of C. D.

4. In all other respects I confirm my said Will.
