We refer to your letter dated 15.05.2007 on the above subject.
We have perused the documents/papers (all photocopies) that you have referred to us including a Memorandum sent by Mr. P, SRM, Chittagong to Mr. Q, HOCRMS of Bank 1 through E-Mail in relation to Our Legal Opinion dated 05.04.2007 and our opinion on the said Memorandum is as follows:
- Regarding the statement/clarification made in Clause 01 of the Memorandum: Since in the submitted P.S. Khatian, the number is ‘P.S. Sabek 777/P.S. Hal 275’ and if there is no ‘P.S. Sabek Khatian No. 777’ corresponding to P.S. Hal Khatian No. 275 then the said number ‘777’ should refer to corresponding R.S. Khatian. But relevant R.S. Khatian number is 356 which is not the same. The landowner should clarify the matter.
- Regarding the statement/clarification made in Clause 02 of the Memorandum: Bank may accept the clarification.
- Regarding the statement/clarification made in Clause 03 of the Memorandum: If Bank intends to accept land measuring 3.0242 acres or lesser measurement as security then Bank needs not to obtain Mutation Khatian for balance land measuring 22.58 decimal.
- Regarding the statement/clarification made in Clause 04 of the Memorandum: Bank may obtain an Affidavit as stated.
All papers/documents referred to us are returned herewith.
