Mutual Will avoiding Rule of Perpetuity

THIS IS THE LAST MUTUAL WILL AND TESTAMENT of us . . . . . . . . and . . . . . . . ., sons of the late . . . . . . . ., residents of . . . . . . . . and. . . . . . . ., respectively.

We declare this to be our last Will and hereby revoke and cancel all testamentary dispositions heretofore made by us jointly or individually.

We have no children born to us and we do not expect any issue to be hereafter born to us. We direct that in case any of us should die the survivor shall enjoy and possess as absolute owner all the properties except the house in our village of . . . . . . . . in district . . . . . . . ., belonging to us with the condition that the widow of the deceased testator and the wife of the surviving testator shall have a charge for their maintenance during the full span of her or their lives on all the properties hereby bequeathed.

The aforesaid house in village . . . . . . . ., we hereby give and bequeath to our wives . . . . . . . . and . . . . . ., as life owners with no power to sell, mortgage or encumber. After their death this house shall pass to our sister . . . . . . . ., who is married to . . . . . . . ., of the said village for her lifetime with a similar restriction regarding transfer. After her death it shall be owned and possessed absolutely by such sons of our said sister as may be born and then living. If no son is born or living it shall be sold and the proceeds given over to any school in the said village.
