The National Sports Council Act, 1974, enacted to create new legislation in response to the requirements of time, considering its provisions.

Since it is expedient and necessary to make new laws in response to the requirements of time, considering the provisions of the National Sports Council Act, 1974 (Act No. LVII of 1974);

Therefore, the law is hereby made as follows: –

Short title and introduction

  1. (3) This Act shall be called National Sports Council Act, 20.

(2) It shall be effective immediately.

Definition

  1. Unless there is anything repugnant in the subject or context, under this Act-

(1) “Executive Committee” means the Executive Committee of the Council constituted under section 12;

(2) “Sport” means a sport which develops the mind, body and intellectual excellence and will be disciplined, open, optional, professional and competitive, and includes sports declared by the Government under Article 8;

(3) “sports body” means the federation, association, board and other bodies formed to conduct sports activities at national and local levels;

(4) “Chairman” means the Chairman of the Council;

(3) “national sports body” means a sports body recognized and recommended under section 4 (1);

(3) “Schedule” means the Schedule of this Act;

(4) “Council” means the National Sports Council established under section 4;

(3) “regulation” means the regulations made under this Act;

(4) “Rule” means the rules made under this Act;

(3) “Vice-Chairman” means the Vice-Chairman of the Finance Council;

(4) “Secretary” means the Secretary of the Finance Council;

(12) “President” means the President of the General Assembly and the Executive Committee;

(4) “Vice-President” means the Vice-President of the General Assembly and the Executive Committee;

(3) “General Council” means the General Assembly constituted under section 4;

(4) “Local sports company” means departmental, district and upazila sports organizations.

Establishment of the Council

  1. (3) The National Sports Council, established under the National Sports Council Act, 1974 (Act No. LVII of 1974), shall remain as it was established under this Act.

(2) The Council shall be a statutory body and shall have a permanent continuity and a common seal, and subject to the provisions of this Act, it shall have the power to acquire, hold and transfer property in both immovable and immovable property, and the Council may sue and file in its own name. A lawsuit can be filed against him in the name.

The functions of the Council

  1. For the purposes of this Act, the functions of the Council shall be as follows: –

(1) To coordinate the sports development and sports activities of the country;

(2) to prepare and implement a training and training plan for sports organizations to participate in international sports competitions;

(3) construction and maintenance of various sports establishments, including stadiums, gyms, swimming pools, playgrounds and training and practice centers;

(4) To arrange for proper training of athletes, trainers, referees, physio, nutritionists and sports doctors of all levels in the field of play;

(3) recognition of sports organizations;

(4) To formulate a model for national sports organizations or any other sports organization

(3) to provide grants to national sports organizations, local sports organizations and other sports organizations for sports activities, and to provide assistance for the construction of stadiums, swimming pools and gyms, and to report, test and verify their audited accounts;

(3) to organize folk sports and sponsor folk sports as a part of the evolution of the national heritage of Bangladesh and the life of its inhabitants, and to promote and promote it abroad.

(4) to consider and approve the inclusion of national sports organizations in the International Sports Association, the Federation or any such association;

(4) approving the list of foreign players and accompanying employees;

(3) publication of books, periodicals, booklets, etc., with the creation of an assortment of information about sports and athletes;

(12) to provide financial assistance and assistance to poor athletes;

(3) award of National Sports Council; And

(3) to perform any other duty conferred upon it by the Government, from time to time, subject to the direction given by it.

Recognize sports organizations and local sports organizations

  1. (3) The Council may, in the manner prescribed by the Rules, grant the recognition and certificate to the sports body as a national sports body.

(2) Upon the formation of a local sports body, it shall be deemed automatically recognized by the Council.

Announcement of sports

  1. For the purpose of this Act, the Government may, by notification in the official Gazette, declare any sport as a sport.

Formation of the General Assembly

  1. (3) For the purpose of this Act, the General Assembly shall consist of the following members, namely:

(a) the Chairman, who shall also be its President;

(B) the Vice-Chairman, who shall also be its Vice-President;

(C) the secretary, youth and sports ministry;

(D) secretary, finance department, finance ministry;

(E) Secretary, Planning Department, Planning Ministry;

(F) Secretary, Public Safety Department, Ministry of Home Affairs;

(G) the Secretary, the Department of Security Services, the Ministry of the Interior;

(H) Secretary, Secondary and Higher Education Department, Ministry of Education;

(I) Secretary, Technical and Madrasah Education Department, Ministry of Education;

(J) Secretary, Ministry of Primary and Mass Education;

(K) Secretary, Ministry of Culture;

(L) Secretary, Information and Communication Technology Department, Ministry of Posts, Telecommunications and Information Technology;

(E) Secretary, Ministry of Liberation War Affairs;

(4) Secretary, National Sports Council;

(O) President, Bangladesh Olympic Association;

(D) Director General, Bangladesh Sports Education Institute;

(L) Director, Directorate of Sports;

(D) the president or general secretary of the national sports organizations;

(B) the editors of all departmental sports organizations and a representative of the district sports organizations, who shall be nominated by the respective bodies;

(N) a representative of the Army’s Sports Control Board;

(P) a representative of the Air Force Sports Control Board;

(F) a representative of the Naval Sports Control Board;

(B) a representative of the Railway Sports Control Board;

(V) a representative of the Border Guard Bangladesh (BGB) Sports Control Board;

(I) Ansar and a representative of the VDP Sports Control Board;

(H) a representative of the Inter-Army Sports Control Board;

(R) a representative of the Inter-University Sports Control Board;

(L) three (three) renowned athletes nominated by the Government, one of whom shall be a sports organizer and a woman; And

(c) Treasurer, National Sports Council;

(S) Director (All), National Sports Council.

(2) The members nominated under clause (l) of sub-section (1) shall hold office for a term of four (four) years from the date of their nomination:

Provided that the Government may, at any time before the expiry of the term, exclude any member of such nominee from the post, without showing the cause, and any nominated member may resign in signed letter for the purpose of the Government.

Chairman

  1. The Minister of Youth and Sports will be the Chairman of the Council of Ministers, and in his absence the Vice-Chairman will serve as the Chairman.

Vice-Chairman

  1. The Minister, the Minister, and the Deputy Minister, if any, shall be two or one Vice-Chairman, except in the Minister, if applicable:

Provided that unless there is a Minister other than the Minister, a member nominated by the Chairman shall be a member of the Council. .

Meetings and activities of the General Assembly

  1. (3) Every two years a general meeting of the General Assembly shall be held and the time, place and procedure of the meeting shall be determined by rules.

(2) For the purposes of this Act, the functions of the General Assembly shall be as follows: –

(a) To advise the functioning of the Executive Committee;

(B) providing advice on policy setting;

(C) reviewing annual income and expense audit reports, annual action plans and future development plans and providing advice on the matter;

(D) to provide other necessary directions.

General management and administration

  1. The general management and administration of the Council shall be vested on the Executive Committee and the Executive Committee may exercise and exercise all the powers that the Council may exercise and perform.

Executive Committee

  1. (3) The Council shall have a working committee and shall consist of the following members, namely:

(a) the Chairman, who shall also be its President;

(B) the Vice-Chairman, who shall also be its Vice-President;

(C) the secretary, youth and sports ministry;

(D) secretary, finance department, finance ministry;

(E) Secretary, Secondary and Higher Education Department, Ministry of Education;

(F) Secretary, Technical and Madrasah Education Department, Ministry of Education;

(G) the Secretary, the Ministry of Primary and Mass Education;

(H) Director General, Bangladesh Sports Education Institute;

(I) Director, Department of Sports;

(J) the President of the Bangladesh Olympic Association or any representative nominated by him;

(K) the President of seven (seven) organizations from each of the National Sports Institutions referred to in Sections No. 1 to 24 of the Schedule;

(L) three (three) renowned athletes nominated by the Government, one of whom shall be a sports organizer and a woman;

(D) Treasurer, National Sports Council; And

(3) the Secretary, who shall also be its Member-Secretary.

(2) The members nominated under clause (l) of sub-section (1) shall hold office for a period of four (four) years from the date of their nomination:

provided that the Government may, at any time before the expiry of that term, cause Except as indicated, any such nominated member may be exempted from the post of member and any nominated member may resign in the form of a signed letter for the Government.

Meeting of the Executive Committee

  1. (4) Subject to the other provisions of this section, the Executive Committee may determine the procedure of its meeting.

(2) There shall be one meeting of the Executive Committee every 3 (three) months and the date, time and place of the meeting shall be determined by the President.

(3) The Secretary shall, with the consent of the President, convene the meeting by written notice.

(3) The President shall preside over all meetings of the Executive Committee, and in his absence the Vice-President shall preside over the meetings.

(4) The quorum of the meeting of the executive committee shall require the presence of an additional one-third of its total members, but no quorum shall be required in the case of the original meeting.

(4) Every member present in the meeting of the executive committee shall have one vote and a decision shall be made on the basis of the vote of the majority of the members, but in the case of equality of votes, the person presiding at the meeting shall have the power to cast a deciding vote.

(4) Just because a vacancy in the post of a member or a flaw in the formation of the executive committee does not invalidate its function or proceedings, nor can any question be raised in relation to it.

Secretary

  1. (3) There shall be a secretary of the council.

(2) The Secretary shall be appointed by the Government and his terms of service shall be fixed by the Government.

(3) The Secretary shall be a full time employee of the Council and he shall exercise the powers and perform the functions conferred on him by the Council and the Executive Committee.

(4) If the post of Secretary is vacant or if he is unable to perform his duties due to absence, illness or any other reason, he shall serve as secretary to any person appointed by the Government until the newly appointed secretary takes office or he is able to resume his duties.

Treasurer

  1. (3) There shall be a Treasurer of the Council.

(2) The Treasurer shall be appointed by the Council and its duties, functions and other terms and conditions shall be determined by the Council.

Employee recruitment

  1. (3) The Council may appoint the required number of employees, subject to the organizational structure approved by the Government, to carry out its functions properly.

(2) Employee recruitment and terms of service shall be determined by regulations.

Funding

  1. (4) For the purpose of this Act, there shall be a fund called the National Sports Council Fund, from which the following sources will be collected, namely: –

(a) a grant from the Government;

(B) the Council’s own income;

(C) grants or loans from any foreign government, agency or individual, with the prior approval of the Government;

(D) the proceeds of the sale of tickets and any other money collected for entering a sports tournament organized by the Council;

(E) a levy for expenditure on the establishment of the Council;

(F) money from the fund; And

(g) grants from any other legitimate source.

(2) The money of the fund shall be deposited in the name of the council in any proposed bank, and from such money the necessary expenses of the council shall be incurred, including the payment of salaries and allowances to the employees.

Explanation: The term “recommendation bank” shall refer to Scheduled Bank as defined in Article 2 (j) of Bangladesh Bank Order, 1972 (President’s Order No. 127 of 1972).

(4) The fund shall be governed in the manner prescribed by the rules, but the fund may be operated in accordance with the rules of the government until the rules are framed.

Budget

  1. The Council shall submit to the Government the annual budget statement of the next fiscal year, with the potential income and expenditure by the Government, at the specified time each year, and shall specify the amount of money the Council will require from the Government in that year.

Accounting and Auditing

  1. (3) The Council shall maintain its accounts in the prescribed manner and prepare an annual statement of accounts.

(2) The Auditor General and the Registrar of Bangladesh shall conduct an audit of the Council every year and shall send a copy of the Audit Report to the Government and the Council.

(3) All records, documents, documents, cash or bank deposits, deposits, deposits and other property belonging to the Auditor General and the Registrar of Bangladesh or any person empowered for such purpose for the purpose of auditing under sub-section (2). And may interrogate any member of the Executive Committee or any member of the Council

(3) In addition to auditing under sub-section (2), the Council may audit its account by a Chartered Accountant as defined in Article 2 (1) (b) of Bangladesh Chartered Accountants Order, 1973 (President’s Order No. 2 of 1973).

Report

  1. (3) Within the next three (three) months after the expiry of each financial year, the Council shall submit to the Government an annual report on the performance of that year.

(2) The Government may, from the Council, at any time, call for any report or statement on any matter from the Council, and the Council shall be obliged to provide it to the Government.

Ad hoc Committee Appointments, etc.

  1. For whatever reason there is no other law, contract or legal document for the time being, the Council is the national sports body or the executive committee of the sports body mentioned in the schedule, as it is called, is not performing its duties properly or conducts activities contrary to the interests of the organization. When appearing, the Executive Committee may dissolve and, if necessary, an ad hoc committee May appoint.

The power of the government to appoint the president of several organizations

  1. For the time being in force, no matter what other law, contract or legal document, there shall be a President who shall be the head of the company described in the Schedule, who shall be nominated by the Government or, as the case may be, elected by law.

The responsibility of national sports organizations

  1. The responsibility of the National Sports Organization shall be as follows: –

(a) The statement of accounts and audit report of its annual income and expenditure shall be submitted to the Council by September of the following year;

(B) to submit to the Council every year the sport in January of that year; And

(c) to comply with any direction given by the Council.

Ability to provide government guidance

  1. For the purposes of this Act, the Government may, from time to time, provide necessary directions to the Council to take such steps as it deems appropriate in the interest of efficient management of the affairs of the Council, and the Council shall be obliged to comply with it.

Ability to amend the schedule

  1. The Government may, by notification in the Official Gazette, amend the schedule.

Ability to make rules

  1. The Government may, by notification in the official Gazette, make rules for the purposes of this Act.

Power to make regulations

  1. For the purpose of this Act, the Council may, with the prior approval of the Government, by notification in the Official Gazette, make such regulations not inconsistent with this Act or Rules.

Cancellation and custody

  1. (3) The National Sports Council Act, 1974 (Act No. LVII of 1974), then referred to as the Act, was hereby repealed.

(2) Notwithstanding the repeal under sub-section (1), the

Council and the Executive Committee constituted under that Act shall remain in force until the General Assembly and the Executive Committee are constituted under this Act;

(B) any act done, any action taken or proceeding shall be deemed to have been done, taken or carried on under this Act;

(C) Any rules made or orders issued or notices shall be deemed to have been made or issued under this Act, subject to conformity with the provisions of this Act.

(3) With the repeal of the Act, the Council established under the Act.

(A) all rights, powers, powers, immovable and immovable properties, cash and bank deposits and funds, funds, investments, all claims, accounts, registers, records and other documents, rights, powers, powers, immovable and immovable of the Council. Property, cash and bank deposits and securities, funds, investments, claims, accounts, accounts, registers, records and documents;

(B) all debts, liabilities, obligations taken and all contracts executed by or on behalf of him, shall be deemed to be the debt, liabilities, obligations and obligations of the Council, respectively, and the contract performed by him, on or against him;

(C) any lawsuit or legal proceedings filed against or on behalf of the Council shall be deemed to be a case or legal proceeding filed by or against the Council;

(D) All officers and employees shall be accounted for by the employees of the Council and shall be appointed on the same terms as they were employed before the commencement of this Act, unless their terms of service are changed by the Council.

  1. (3) After the enactment of this Act, the Government may, by notification in the Official Gazette, publish an Authentic English Text translated into English of the original Bengali text of this Act.

(2) In the case of a dispute between the Bengali and the English text, the Bengali text shall prevail.
