Rule—143

Although
in sub-rule (2) no authority has been mentioned to whom a written defence has
to be submitted, the written defence has to be submitted to the enquiry officer
appointed to held the enquiry.

(Uma) and 18(1) (2)

Under
Section 2 (Uma) of the Premises Rent Control Ordinance, the person who
continues in possession after the termination of the tenancy and pays rent to
the landlord is a tenant. Rent Control legislation is a special law which gives
a greater protection to a tenant against eviction so long as he pays rent to
the full extent allowable by the Ordinance and performs the conditions of the
tenancy.
