Sections 9 and 55(3)—

The
Appointing Authority has power under section 16 of the General Clauses Act to
suspend, dismiss and remove the Vice—Chancellor, although there is no specific
provision in the Rajshahi University Act itself for removing the
Vice—Chancellor of the University. The procedure laid down in section 5(3) of
the Rajshahi University Act 1973 is not applicable to the Vice—Chancellor for
ifhe is taken to be an officer of the University then as per section 9 of the
said Act the Chancellor should also be deemed to be an officer of the
University to be dealt with in accordance with the procedure laid down in
section 55(3) of the same Act which is nothing but an absurdity.
