RE: VETTING OF PROPERTY DOCUMENTS/PAPERS TO ESTABLISH A KIOSK AT SIRAJDIKHAN BAZAR, MUNSHIGANJ

We refer to your letter dated 01.10.07 on the above subject.

We have perused the documents/papers that you have referred to us and as per your request letter dated 01.10.07 we have vetted the documents only on land measuring 05 decimals fully described therein and under column 02 of this opinion and our opinion the same is as follows:

1. Owner of the property  : Mr. B son of Mr. X of Village and P.S. Sirajdikhan, Dist. Munshiganj.
2. Description of the property : All that piece and parcel of land measuring 05 decimal situated within District Munshiganj, P.S. and Sub-Registry Office Sirajdikhan, Touzi No. 265, J.L. No. 68, Mouza Sirajdikhan, Khatian No. 03, Dag No. 147.
3. Area : 05 decimals
4. Title Deed : Deed of Exchange No. 4466 dated 18.10.1993 executed between Mr. B and Sirajdikhan Prathamik Shikkhak Samiti represented by its Chairman Mr. P and Mr. Q.
5. Bia Deed : Not submitted.
6. Mutation : Mutation Khatian No.3 certified by Assistant Commissioner of Land along with DCR has been submitted from which it appears that land (Bhiti) measuring 05 decimal under S.A. Dag No. 147 has been mutated in the name of Mr. B vide Mutation and Separation Case No. 355/93-94 dated 01.12.93.
7. Khatian : S.A. Khatian No. 3 and R.S. Khatian No. 124 have been submitted. Bank may obtain relevant C.S. Khatian.
8. Chain of Ownership : Without perusing all relevant khatian and bia deeds it is difficult to ascertain the complete chain of ownership. However upon perusing the submitted documents, the following chain of ownership can be drawn:From S.A. Khatian No. 3 it appears that land measuring 17 decimal under Dag No. 147 was recorded in the name of Mosammat Hosneara Begum, Ulfatrul Karim, and Mohammad Munjarul Karim.

From R.S. Khatian No.124 it appears that land measuring 05 decimal under Dag No. 128, land measuring 12 decimal under Dag No. 129 were recorded in the name of Sirajdikhan Thana Prathamic Shikkhak Shamiti represented by its Secretary Mokhlesur Rahman. Please note that we have not been provided with any documents showing how the R.S. tenant became owner of the land from the S.A. tenants.

Mr. B has become owner of land measuring 05 decimal out of the said land by way of exchange another land with Sirajdikhan Prathamik Shikkhak Samiti represented by its Chairman Mr. P and Mr. Q vide Deed of Exchange No. 4466 dated 18.10.1993.

9. Ground Rent Receipt : Two ground rent receipt being No. K 150868 and illegible has been submitted from which it appears that ground rent has been paid up to 1402 B.S. in the name of Mr. B for land measuring 05 decimal under Dag No. 147.Up to date ground rent receipt land measuring 05 decimal should be obtained.
10. Valuation Certificates : Not submitted.
11. Non-Encumbrance Certificate : Non encumbrance certificate dated 11.07.2007 issued by deed writer Md. Raihan Mollah along with Govt. Receipt No. 3043 for land measuring 05 decimal from the year 1993 to 2007 has been submitted.
12. Municipal Holding Record : Not submitted.

Up to date municipal tax payment receipt should be obtained, if applicable.

13. Wanting papers/Documents : a)      Up to date ground rent receipt for land measuring 05 decimal.b)      Up to date municipal tax payment receipt, if applicable.
14. Opinion : Upon perusal of the documents/papers we are of the opinion that Mr. B has acquired prima facie right, title and interest over the land in question. Bank may obtain papers/documents referred in Clause 13.We have provided this opinion on the basis of the documents/papers referred to us. We do not confirm the genuineness of the submitted documents. You may verify the genuineness of the same with the concerned Sub-registry office or concerned authorities.

All papers/documents referred to us are returned herewith.
