1. On 1st May 2002 at about 9.00pm.The claimant was driving his Jaguar motor car registration M208 RGD in a westerly direction along the A45 highway when at the junction of the highway with Offchurch Lane, near Drexford, the defendant drove his Austin Metro motor car registration number T283 KEN, into the claimant’s motor car.The accident was caused by the negligence of the defendant.PARTICULARS OF CLAIM

PARTICULARS OF NEGLIGENCE

2. The defendant was negligent in that:

a)      drove onto the A45 highway from Offchurch Lane without keeping a proper look out.

b)      failed to give precedence to the claimant’s car at the junction.

c)      failed to stop, steer or otherwise control his car so as to avoid striking the claimant’s motor car.

3. As a result of the matters set out above the claimant suffered pain and injury sustained loss and damage.
