RE: LEGAL NOTICE.
We act for our client Lt. Col. M. x Our clients have instructed us to serve this legal notice upon you as follows:
01. That our client is the Managing Director of Company 1. Our client is a reputable businessman in the society. He is a well-established and renowned business personality enjoying respectable status in the society. He has earned name and fame through his hard work, integrity and well-mannered work ethics over the years.
02. That our client is the Chairman of Company 2, Managing Director of Company 3, Managing Director of Company 4, Member of Company 5, Member of the general body of the Company 6 (COMPANY 6), Member of Company 7 (COMPANY 7), Member of American Chamber of Commerce (Amcham). He was the Chief Election Commissioner of the Federation of Bangladesh Chamber of Commerce and Industries (COMPANY 6) for the Term of 2000-2002. He has once again been elected the Chief Election Commissioner of the Federation of Bangladesh Chamber of Commerce and Industries (COMPANY 6) for the Term of 2003-2005. He has been elected the Chief Election Commissioner of the Bangladesh Garments Manufacturer & Exporter Association (BGMEA) for the Term of 2003-2004. He has also been elected the Chief Election Commissioner of the Bangladesh Knitwear Manufacturer & Exporter Association (BKMEA) for the Term of 2002-2003.
03. That you have involved into various disputes and disagreements with our client with regard to the business affairs of COMPANY 2 and the matter eventually proceeded to Court cases. The disputes and disagreements are still pending in the Courts.
04. That pending disposal of the Court cases you have been making various correspondences to different persons including e-mail dated November, 14, 2002 sent to the Ambassador, USA copy of which was forwarded to our client.
05. That from your aforesaid correspondences including e-mail dated November, 14, 2002 it appears that you have been making and publishing false and defamatory statements against our client.
06. That recently in your e-mail dated November, 14, 2002 sent to the Ambassador, USA you have made following false and frivolous statement –
“the local members of the company (i.e. our client) in the past, have been giving me tough time including attempt on my life in Bangladesh”
and accordingly you sought help of the Ambassador of the USA. Your such false and frivolous statement published through your aforesaid e-mail has lowered the goodwill, esteem and repute of our client in the estimation of the right thinking persons of the society and thus you have defamed our client.
In such circumstances you are requested to justify your aforesaid statements made in your e-mail dated November, 14, 2002 sent to the Ambassador, USA or to pay compensation of Tk. 2,00,00,000.00 (Taka two crore) only to our client within 15 (fifteen) days of your receipt of this notice. Should you fail to justify your aforesaid statements within the stipulated period, we have instructions from our client to initiate legal action (both civil and criminal) against you for defaming our client.
A copy of this notice is kept in our office for future reference.
