Re:       Legal opinion regarding allowing custodian to withdraw the amount of the savings A/C no. 002-078525-001.

We refer to our letter dated 06.06.2006 and your letter dated 15.06.2006 on the above subject.

We have perused the all papers/documents (photocopy) referred to us and the contents of your letter dated 31.05.2006 in which you have requested us to give our opinion on whether BANK 1 can disburse the amount in savings A/C no. 002-078525-001 to the custodian of the minors or not.

OUR OPINION:

It appears that a case being No. 531 of 2006 had been filed by Mr. x on behalf of the minors Mr. A and Mr. B. Consequently, on 28.05.2006 a succession certificate has been granted to the minors by Joint District Judge, 3rd Court, Dhaka as the delegated authority of the District Judge. Furthermore, it appears 5th Additional Assistant Judge and Family Court, Dhaka vide its order dated 02.05.2006 in Family Suit No. 132/06 have appointed Mr. x, as guardian/custodian of the minors.

In such situation we are of the opinion that BANK 1 can disburse the amount in savings A/C no. 002-078525-001 to Mr. x as custodian/guardian of the minors.

We are sending herewith all papers/documents (photocopy) referred to us.
