   An application under Section 47 of the    Evidence Act, 1872 for the handwriting   expert read with section 57 of the Artha Rin Adalat Ain, 2003

The petitioner most respectfully-

SHEWETH:

  1. That the petitioner of the instant Mis. Case could not contest in the Artha Rin Suit No. 528/2004 filed on 31.03.2004 because of the fraudulent activities of the opposite party.
  1. That the opposite party in collusion with other interested party fraudulently submitted a vokalatnama being dated 03.10.2004 on behalf of the petitioner which was neither signed by the petitioner nor authorized by the petitioner.
  1. That the opposite party forged the signature of the petitioner and submitted such forged vokalatnama with the intention to defraud the petitioner and deprived him to contest the said Artha Rin suit.
  1.  That in order to determine whether the hand-writing of the said vokalatnama was forged, it is necessary to scrutiny the forged signature by a hand-writing expert.

Therefore, it is humbly prayed to the learned Court that your honour would graciously be pleased to issue an order to determine the genuineness of the signature in the said vokalatnama for the ends of justice and pass any other or further order or orders which the learned Court may deem fit and proper.

And for this act of kindness the petitioner as in duty bound shall ever pray.
