01. That the plaintiff bank has filed Money Suit No. 38 of 2003 in Joint District Judge 5th Court, Dhaka on 08.07.2003 against the defendant bank as principal defendant. Subsequently the said suit has been transferred from 5th Joint District Judge, Dhaka to 3rd Artha Rin Court, Dhaka and renumbered as Artha Rin Suit No. 247 of 2003.

02. That after filing the suit, the plaintiff bank and the defendant bank have decided to settle the matter amicably and the plaintiff bank has already received the settled amount from the defendant bank.

03. That in such situation the management of the plaintiff bank has taken decision to withdraw the instant suit on satisfaction and as such this suit is required to be withdrawn on satisfaction of the plaintiff bank.

04. That this application has been filed bonafide.

Wherefore it is humbly prayed that your Honour would graciously be pleased to allow the application and thereby permit the plaintiff bank to withdraw the instant suit on satisfaction.

AND for this act of kindness the plaintiff bank as in duty bound shall ever pray.

1. That I am the tadbirker of the plaintiff bank of this suit and well conversant with the facts of the case and competent to swear this Affidavit.

That the statements of facts made in this petition are true to the best of my knowledge and belief and rests are submissions before this Hon’ble Court and in witness whereof I swear this affidavit and signed below on this the 30 day of November, 2005 at _________ a.m. before the Commissioner of affidavit.
