1. Pursuant to the said agreement and in consideration of the said sum

by sold conveyed transferred and assigned of otherwise assured or
intended so to be unto and to the use of the Purchasers absolutely.
2. The Vendor doth hereby covenant with the Purchasers as follows :
(a) That notwithstanding any act deed or thing done committed or
knowingly suffered by it to the contrary the Vendor is lawfully and
rightfully seized and possessed or of otherwise well and suffi-
ciently entitled to the said property being Plot No…….. comprised
within the premises No……… more fully described in the Schedule
hereunder and delineated in the plan hereto annexed hereby sold
conveyed transferred and assigned as an absolute and indefea-
sible estate equivalent thereto free from all encumbrances what-
soever and that the Vendor has fully power and absolute and
indefeasible  tight and authority to sell grant convey and transfer

der unto the Purchasers in the manner aforesaid and according
to the true intent and meaning of these presents.
(b) That it shall be lawful for the Purchasers at all times hereafter

receive the rents issues and profits thereof without any hindrance
interruption disturbances claim or demand whatsoever by the
Vendor or any person or persons claiming any estate right title and
interest from under through or in trust for the Vendor and freely and
clearly and absolutely acquainted exonerated and for ever dis-
charges or otherwise by the Vendor well and sufficiently saved
defendant kept harmless and indemnified of and from against all
charges and encumbrances whatsoever made done executed or
occasioned by the Vendor.
(c) The Vendor and all persons claiming any right title or interest in

from under of in trust for the Vendor shall and will from time to times
hereafter at the request and cost of the purchasers do or execute
or cause to be done or executed all such lawful acts deeds and
things.  Whatsoever for further and more perfectly conveying and
assuring the said property and every part thereof hereby granted

the true intent and meaning of this Deed and it shall be lawful for
the Purchasers at all times hereafter to move with horse carts
carriages, motors, or other vehicles and pass and repass over
along the said roads and passages and leading to out of the said
premises and lay down drains sewers gas electric telephone lines
water connection pipes under the said common passages or roads
and passages.
3. The  Vendor doth hereby further Covenant with the Purchasers that
the Vendor shall and will from time to time and at all times hereafter upon
every reasonable request and at the cost of the Purchasers produce or
cause to be produced to the Purchasers or their solicitors or agents or at
any trial hearing examination on commission or otherwise as occasion shall
require the title deeds  for the purpose of showing and manifesting the title
of the Purchasers to the Plot being No……….. comprised within the premises
No……… hereby conveyed or expressed to so be or any part thereof and
at the like request and cost deliver copies or extracts from the said

NOW THIS INDENTURE WITNESSES that in pursuance of the said agree-

notwithstanding any acts deed or things heretobefore done, executed or
knowingly suffered to the contrary the Vendor is now lawfully, seized and
possessed of the said flat hereby conveyed to the Purchaser, subject to the
said Mortgage and Charge but free from all other encumbrances attach-

Vendor further covenant that it shall at the request and cost of the Purchaser
do or execute or cause to be done or executed all such lawful acts, deeds
and things whatsoever for further and perfectly conveying and assuring the
said flat and every part thereof in manner aforesaid according to the true

AND it is further agreed and declared by and between the parties as
follows:
(1) The Purchaser shall be liable to pay directly to the authorities or
contribute in proportion to the floor area of the flat and garage, if any, hereby
conveyed to the Purchaser towards payment of municipal taxes and other
outgoings, maintenance charges for the common areas of the said building
and  in cases where the said payments are not made directly to any statutory
authority then the same shall be made by the Purchaser to the co-owners
of the flats in the said building represented by the Co-operative Society, the
Vendor herein, and for the said purpose the said Society or all other  co-
owners of the diverse flats in the said building as a body  shall have right
of attachment and sales of the Purchaser?s Flat No…….. as security for the
dues as aforesaid in case of non-payment.
(2) The Purchaser shall be liable to make timely repayment of any other
sum as may be required by the………. towards the loan secured against
mortgage of the said flat at the time of execution of  a proper Deed of
Release in respect of the said flat in favour of the Purchaser.
(3) The Purchaser shall have full and absolute proprietary rights such
as the Vendor derives from its title save and except that of demolishing or

hereto in any manner whatsoever so as to effect the Vendor or other co-

(4)  The Purchaser shall hold and shall be entitled to sell, mortgage, lease
