The Livestock Research Institute Ordinance, 1984 Considering its provisions, the law created to create new laws in response to the needs of time

Since the passage of Article 4 of the Fourth Schedule of the Constitution of the People’s Republic of Bangladesh on the approval and support of the ordinances issued by the military decree from March 12 to November 7, by the Constitution (Fifth Amendment) Act, 27 (Act No. 8 of 24). No. 8/21 unanimously upheld the military law in the judgment given by the Appellate Division of the Supreme Court. Mbidhanika ghosanapurbaka validation provider of the Constitution (Seventh Amendment) Act, 1986 (Act No.1 of 1986) was annulled ordinances, the effectiveness of the period has come to an end; And

since the ordinance No. 2 of 24 has kept some of these ordinances in force; And

Since, after reviewing the requirements and relevance of the said ordinances, the ordinances considered are required of all stakeholders and all the ministries and departments, and the government has decided to make new laws in Bengal in response to the demands of the time for necessary correction and refinement; And

since in the light of the Government’s above-mentioned decisions, it is expedient and necessary to make new laws in response to the demands of time in order to abolish The Livestock Research Institute Ordinance, 1984 (Ordinance No. XXVIII 1984);

Therefore, the law is hereby made as follows: –

Short title and introduction

  1. (3) This Act shall be called Bangladesh Livestock Research Institute Act, 20.

(2) It shall be effective immediately.

Definition

  1. Unless there is anything repugnant in the subject or context, under this Act-

(1) “Institute” means the Bangladesh Livestock Research Institute established under section 1;

(2) “Co-Chairman” means the Co-Chairman of the Board;

(4) “Chairman” means the Chairman of the Board;

(3) “regulation” means the regulations made under this Act;

(3) “livestock or animals” means any animal or poultry that can be raised in the house or on the farm and for this purpose any other animal declared by the Government, from time to time, in the Gazette notification;

(3) “poultry” means any bird that can be raised in the house or on the farm;

(4) “Rule” means the rules made under this Act;

(4) “Board” means the Board of Directors constituted under section 4;

(4) “Director General” means the Director-General of the Institute; And

(4) “Member” means a member of the Board.

Establishment of the Institute

  1. (1) The Livestock Research Institute established under the Livestock Research Institute Ordinance, 1984 (Ordinance No. XXVIII of 1984) shall be deemed to have been established under this Act as an institute called Bangladesh Livestock Research Institute.

(2) The Institute shall be a statutory body and shall have a permanent continuity and a general seal and subject to the provisions of this Act, it shall have the power to acquire, hold, and transfer property, both immovable and immovable, and may file a suit in its own name. A lawsuit can be filed against him in the name.

Office of the Institute, Regional Center, etc.

  1. (3) The Head Office of the Institute shall be in Dhaka.

(2) The Board may, if required, with the prior approval of the Government, establish its regional center at any place in the country.

Application of the Law of Bangladesh Agricultural Research Council

  1. (1) Instructions, recommendations or suggestions given by the Council constituted under section 4 of the Bangladesh Agricultural Research Council Act, 202 (Act No. 2 of 202) shall be followed by the Institute:

Provided that, if it appears to the Institute that such If the recommendation or suggestion is not feasible, the Institute will promptly notify the Council of its opinion, citing the reasons.

(2) Considering the opinion received from the Institute under sub-section (1), the Council may amend or reject any recommendation or suggestion given by it or give any new recommendation or suggestion on the matter.

Management and administration

  1. The management and administration of the Institute shall be vested under a Board and the Board may exercise and exercise all the powers that the Institute may exercise.

Board structure

  1. (3) The Board of Directors of the Institute shall consist of the following members, namely: –

(a) the Minister, the Ministry of Fisheries and Livestock, who shall also be the Chairman of the Board;

(B) the Minister or Deputy Minister, if any, the Ministry of Fisheries and Livestock, who shall also be the Co-Chairman of the Board;

(C) two (two) MPs nominated by the Speaker of the Parliament;

(D) the Secretary, the Ministry of Fisheries and Livestock, who shall also be the Vice-Chairman of the Board;

(E) Member (Agriculture, Water Resources and Rural Institution) Planning Commission;

(F) Vice-Chancellor, Bangladesh Agricultural University;

(G) Executive Chairman, Bangladesh Agricultural Research Council;

(H) one (1) representative of the rank of Additional Additional Secretary nominated by the Finance Department;

(I) the Director General, Directorate of Livestock;

(J) two (two) employees engaged in the research work of the Institute nominated by the Government;

(K) 2 (two) persons, of whom 1 (one) shall be female, who are experienced and interested in the matters of livestock designated by the Government;

(L) The Director-General, who shall also be a Member-Secretary of the Board.

(2) In subsection (a) and (b) of sub-section (1), if there is no Minister and the Minister and Deputy Minister are the State Chairman and the Deputy Minister shall be the Co-Chairman and not the Minister and the Minister of State. The Deputy Minister will be the Chairman if there is one.

(3) The members nominated under sub-section (1) shall remain in office for a period of three (three) years from the date of their nomination:

Provided that the Government may, at any time before the expiry of the term, be nominated without showing The member may be exempted from the post.

(4) A member may resign at any time for his signature on the letter of the government.

Functions of the Board

  1. (3) The functions of the Board shall be as follows: –

(a) Policy approval of administrative and financial matters of the Institute;

(B) to supervise and direct the activities of the Institute;

(C) making decisions on the policy matters of the Institute;

(D) formulate and approve the policies, action plans required for the management of the Institute;

(E) decision making on borrowing and approval of such proposals;

(F) to approve financial assistance for higher education or research abroad;

(G) Implement any government directive or program consistent with this Act.

(2) The Board shall follow these laws, rules and regulations in the discharge of its duties and functions.

Meeting of the Board

  1. (4) Subject to the other provisions of this section, the Board may determine the procedure for its meeting.

(2) The meetings of the Board shall be held at the date, time and place set by the Chairman.

(3) There shall be at least one (one) meeting of the Board every 3 (three) months.

(4) The Member-Secretary of the Board shall convene a meeting of the Board by written notice, with the consent of the Chairman.

(4) The chairman shall preside over all meetings of the board, but in his absence the vice-chairman and vice-chairman shall preside over the meeting in the absence of both.

(4) The quorum of the meeting of the Board shall require the presence of at least one-third of its total members, but in case of adjournment meetings, no quorum is required.

(3) The preservation of the proceedings of each meeting shall be forwarded to the members and presented to the next board meeting.

(3) Every member present at the meeting of the Board shall have one vote and a decision shall be taken on the basis of the majority vote, but in the case of equality of the votes cast, the President may issue a deciding vote.

(4) No vacancy in the post of any member of the Board or due to errors in the formation of the Board shall not invalidate the proceedings or proceedings of the Board and no question shall be raised in connection with it.

The capabilities and functions of the Institute

  1. To fulfill the purpose of this Act, the powers and functions of the Institute shall be as follows: –

(a) To identify or identify the fundamental problems of the livestock of the country through research;

(B) to develop methods suitable for the rapid identification and treatment of various diseases of livestock;

(C) conducting epidemiological research to determine the effects of various diseases caused by bacteria, viruses, fungi and parasites on livestock production and their infection;

(D) to study the immune system of the animal’s body in relation to diseases caused by various types of germs in animals and poultry, and to develop appropriate technology for the proper prevention of diseases;

(E) to develop improved varieties of livestock to increase the production of milk, meat and cultivation energy, and to develop improved varieties of poultry to increase the production of eggs and meat;

(F) development of animal feed production and conservation practices and ensuring maximum utilization of agro-based byproducts, leftovers and obsolete food products;

(G) to develop long-term sustainable livestock production strategies to provide livestock during emergencies;

(H) to develop standardized vaccines in various ways to eradicate the disease from animals to research in the prevention of Zoonotic Diseases and Trans-boundary Animal Diseases;

(I) conducting one health research on the control of Zoonotic Diseases from animals to humans;

(J) to develop management strategies to protect the health of animals and increase production;

(K) to evaluate the medicinal properties of indigenous herbs as a medicine in the treatment of livestock and to examine the possibility of using them;

(L) identifying plants that are harmful to animal health and identifying ways to detect and remedy their adverse effects;

(D) to develop necessary and advanced methods for the collection, storage and processing of livestock, to prevent its digestion and to maintain quality in the conservation;

(3) to calculate the cost of production of animals and the various components of the livestock produced;

(O) to innovate and develop new technologies, knowledge to increase livestock production in this country of increasing population;

(T) coordinating and controlling the field level offices for the activities related to the research findings on livestock;

(L) organizing seminars, seminars or workshops on various issues related to livestock matters of national importance;

(E) conducting research activities on biotechnology and nanotechnology for the purpose of poultry and livestock development;

(B) conducting research work on poultry and livestock by region;

(N) to convey information regarding research on livestock to the farmer;

(P) to diagnose problems related to the marketing of livestock and its products and to develop appropriate methods for marketing it including the classification of livestock;

(F) conducting research on safe animal feed;

(B) to execute a contract with any person or institution and any foreign donor agency for the purpose of this Act;

(V) To perform any other functions necessary to fulfill the purpose of this Act.

Studies on the management of animal waste

  1. The institute will develop methods for conducting research on the nature and versatile utility of animal waste and its environmentally friendly management.

Director General

  1. (3) There shall be a Director General of the Institute.

(2) The Director General shall be appointed by the Government and the terms and conditions of his employment shall be determined by the Government.

(4) The Director General shall be the Chief Executive of the Institute and he shall –

(a) be responsible for implementing the decisions of the Board;

(B) perform and administer the functions of the Institute on behalf of the Board; And

(c) from time to time, the duties assigned to it by the Government or the Board.

(4) If the post of director general becomes vacant or for any other reason he is unable to fulfill his duties, a person appointed by the government shall act as the director general until the newly appointed director general takes office or he is able to resume his duties.

Employee recruitment, etc.

  1. The Institute may appoint the required number of employees, subject to the organizational structure approved by the Government, in order to perform its functions properly and their terms of service shall be determined by the regulations.

Funding

  1. (3) The Institute shall have a fund and shall collect funds from the following sources, namely: –

(a) Government-funded grants;

(B) loans taken;

(C) income from research interests and services;

(D) grants received from any local or foreign development aid agency with the prior approval of the Government;

(E) grants made by a local authority;

(F) money received from his own income or from any other legitimate source.

(2) All funds of the Fund shall be deposited in the name of the Institute in the Bank of the Proposal and the Fund shall be governed in the manner prescribed by the Rules:

Provided that the funds shall be maintained in the manner prescribed by the Board until the rules are made.

Explanation.- The term “recommendation bank” shall refer to the Scheduled Bank aligned to Article 2 (j) of Bangladesh Bank Order, 1972 (President’s Order No. 127 of 1972).

(4) From the fund, the necessary expenses of the Institute may be deducted in accordance with the rules and regulations of the Government.

Budget

  1. The Institute shall submit to the Government the annual budget statement of the next financial year, with the potential income and expenditure by the Government, within a specified period of time, and shall state the amount of money required for the Institute from the Government in that fiscal year.

Accounting and Auditing

  1. (3) The Institute shall maintain its accounts in the manner prescribed by the Government and shall prepare annual statement of accounts.

(2) The Auditor General and the Registrar of Bangladesh, hereinafter referred to as the Auditor General, shall audit the Institute every year and send a copy of the Audit Report to the Government and the Institute.

(3) For the purpose of accounting under sub-section (2), the Auditor General or any person empowered by him for such purpose shall inspect all records, documents, cash or bank deposits, deposits, deposits and other property of the Institute. Ask any member of the board or any employee of the institute.

(1) In addition to the audit under sub-section (2), the Institute may conduct the audit of the Institute every year by a Chartered Accountant as defined in Article 2 (1) (b) of Bangladesh Chartered Accountants Order, 1973 (PONo. 2 of 1973).

(3) The Institute shall, as soon as possible, take steps to remedy any errors or irregularities identified in the audit report.

Report

  1. (3) Within the next three (three) months after the expiry of each financial year, the Institute shall submit to the Government an annual report on the performance of that year.

(2) The Government may, at any time, from the Institute, report to the Institute any report and statement on its activities and the Institute shall be obliged to provide it to the Government.

Fees, etc.

  1. (4) From a person or organization, the Institute may charge fees from the Institute for providing advice on science, technology, livestock industry setting up or inquiry.

(2) A certain portion of the fees payable under subsection (1) shall be received by the concerned scientific officer or higher scientific officer, and the remainder shall be deposited in the funds of the Institute.

Intellectual Property

  1. (4) The articles published in the research proceedings conducted by the Institute or funded by the Institute shall be deemed to be the property of the Institute.

(2) The Institute shall reserve the patent and copyright rights of the property referred to in sub-section (1) or, in the case, may register the geographical product indicator of that property.

(4) The property institute referred to in sub-section (1) may be provided to any person or institution for use in the research work of livestock, in a manner prescribed by regulations.

The committee

  1. The Institute may constitute one or more committees to assist in the discharge of its duties and may determine the responsibilities and functions of such committees.

Handing over power

  1. The Board may, if necessary, delegate any of its powers or responsibilities to the Director General, any member or any other employee of the Institute.

Ability to make rules

  1. The Government may, by notification in the official Gazette, make rules for the purposes of this Act.

Ability to make regulations

  1. For the purpose of this Act, the Institute may, with the prior approval of the Government, make regulations by complying with this Act or Rules by notification in the Official Gazette.

Cancellation and custody

  1. (4) The Livestock Research Institute Ordinance, 1984 (Ordinance No. XXVIII of 1984), hereinafter referred to as the Ordinance, was hereby repealed.

(2) Notwithstanding such repeal under sub-section (1), under that Ordinance—

(a) all acts or acts performed shall be deemed to have been taken or taken under this Act;

(B) any action taken or any proceeding taken shall be disposed of as if it were adopted or initiated under this Act;

(C) any order issued, any notice given, projected budget estimate, scheme or project shall be deemed to have been issued, given, made or prepared under this Act;

(D) any rules, regulations, any notices issued, any orders or notices issued shall be subject to compliance with this Act and will remain in force until repealed or amended under this Act; And

(e) the established Regional Centers shall be maintained as if they were established under this Act.

(3) With the termination of the said Ordinance, the Livestock Research Institute established under the said Ordinance shall:

(A) All assets, rights, powers, powers, benefits, funds, all immovable and immovable properties, cash and bank deposits, all other claims and rights, all accounts, registers, records and other documents established under section 4 of Bangladesh. The Livestock Research Institute, hereinafter referred to as the Institute, has its assets, rights, powers, authority, benefits and immovable and immovable properties, claiming money and Shall be treated as an accounting, register record and document;

(B) all debts, liabilities and obligations and all contracts made by or on behalf of him, shall be deemed to be the loans, liabilities and obligations of the Institute, respectively, and the contract performed by him, on or with him;

(C) the lawsuit or legal proceedings filed against or on behalf of the Institute shall be deemed to be a case or legal proceeding filed by or against the Institute;

(D) All officers and employees shall be regarded as employees of the Institute and shall continue to be employed and functioned on the same terms and conditions, until the time of the enactment of this Act, unless they change the terms of the Act;

(E) Intellectual and research assets or assets shall be deemed to have been acquired and received by the Institute.

  1. (3) After the enactment of this Act, the Government may, by notification in the Official Gazette, publish an Authentic English Text translated into English of the original Bengali text of this Act.

(2) This law shall prevail in the case of a dispute between this Act and the English text.
