Agrani
Bank (Employees) Service Regubiions, 1991—Regulation No. 28(II)(e)— Whether
second show cause mandatory fore dismissal—Agrani Bank Ltd. Service Rules and
Regulations not in existence when !epartmenta1 proceeding was initiated against
the appellant—Appellant dismissed from service after coming into force of the
Agrani Bank (Employees) Service Regulation, 1981 Service Rules come into effect
on 12.9.81, departmental inquiry commenced on 12.1.82, ‘inquiry report
submitted on 2.6.82 and dismissed from service on 29.11.82).

Appellant’s
cases governed by the provision of Regulation No. 28(II)(e) and the appellant
was entitled to second show cause notice before the order of dismissal was
passed.
