Agreement between Manager of School and Teacher

THIS AGREEMENT is made the. . . . . . . . . .day of. . . . . . . . , 20. . . . . ., BETWEEN The. . . . . . . . . . High School. . . . . . . . . ., hereinafter for the sake of brevity called the ‘‘School’’, acting through its Manager, Shri . . . . . . . . . .of the one part, AND C. D., aged about. . . . . . . . . .years, son of. . . . . . . . . ., resident of. . . . . . . . . ., hereinafter for the sake of brevity called the ‘‘Teacher’’ of the other part.

WHEREAS the School is in need of the services of a proficient and qualified teacher and for the said purposes invited applications from persons possessing the required qualification and the Teacher by his application in writing, dated. . . . . . . . . ., offered his services as such teacher;

AND WHEREAS the School on the strength of the allegations as to qualifications of the said Teacher made in the said application, dated. . . . . . . . . , selected the Teacher to be so appointed:

NOW, THEREFORE, THIS DEED WITNESSES AS FOLLOWS:

1. That the School hereby engages the Teacher for the purposes of teaching and otherwise instructing students studying in the School on the terms hereinafter appearing.

2. That the School shall during the conitnuance of this agreement pay to the Teacher a basic salary of Rupees . . . . . . . . . . (Rs . . . . . . . . . .) only per month with yearly increment of Rs . . . . . . rising to a maximum salary of Rs . . . . . . . . . (Rs . . . . .) only. Such salary shall fall due on the last day of each calendar month and shall be payable by the School to the Teacher within the first week of each succeeding month.

3. That all allowances, gratuities etc., due and payable in addition to the basic pay shall be governed by the rules in this behalf and shall unless the rules in this behalf provide otherwise be payable to the Teacher together with his pay.

4. That the Teacher shall perform his duties honestly and diligently and shall attend the classes at such hours each day as may be specified by the Headmaster and shall impart such lessons and instruction whether in the classes or outside, as may from time to time be directed by the Headmaster.

5. That in all matters of internal organisation, discipline, allotment of classes and subjects etc., the Teacher shall be bound by the decisions and directions of the Headmaster as may be given or imposed from time to time.

6. That the Teacher shall be entitled to such leave as may be allowed by the rules framed by the School or Government.

7. That the School may dismiss the Teacher in case of gross misconduct without notice or compensation in lieu of notice but after payment of all salary due up to the date of dismissal. In any other case this contract may be terminated by either party by giving the other one month’s notice terminating with the last day of the educational session.

8. That clause 2 of this Agreement regarding yearly increments shall come into operation after confirmation of the Teacher’s appointment, which shall be done on the completion of one educational session by the School on the condition that the Teacher works honestly, loyally and diligently and the Headmaster recommends such confirmation.

9. That during the continuance of this Agreement the Teacher shall not be permitted to carry on any other trade or profession nor shall be directly or indirectly interested in any other School or educational institution. The teacher shall also not give private lessons to any student unless so permitted by the School in writing.
