Agreement of Separation between Husband and Wife

THIS AGREEMENT is made the . . . . . . . . . . . . day of . . . . . . . . in the year 20 . . . . ., BETWEEN A. B., aged . . . . . . . years, son of . . . . . . . . . ., resident of . . . . . . ., (hereinafter called the ‘Husband’) of the one part AND C. D., aged . . . . . . . . years, daughter of . . . . . . . . and wife of the husband (hereinafter called the ‘Wife’) of the other part.

WHEREAS the said A. B. was married to the aforesaid C. D. under the . . .  Marriage Act. . . . . . . . .at. . . . . . . .on the. . . . . . . . . . . . .and the said marriage was duly registered before. . . . . . . . . . at . . . . . on. . . . . . . . . . . . .;

AND WHEREAS after a few months of the said marriage unhappy relations, frequent quarrels resulting form incompatibility of temperament started existing (if the reason is other than incompatibility of temperament give the reasons here) AND in order to avoid a further deterioration of the situation the wife with the advice of friends and relations and the consent of the husband left the protection and the house of the husband to reside with her parents;

AND WHEREAS out of the said marriage a male child was born on . . . . . . . . . at the house of the wife’s parents;

AND WHEREAS the said child died on . . . . . . . . . .and now there is no likelihood of any further issues being born;

AND WHEREAS the parties belong to . . . . . . . . . community and profess the . . . . . . . . . religion;

NOW, THEREFORE, THIS DEED OF SEPARATION WITNESSES that in consideration of the wife foregoing all claims of maintenance, inheritance, etc., the husband does hereby release her from all obligations, financial and matrimonial, resulting from her marriage with the husband, AND it is further declared that the wife has been allowed to take away all the jewellery and goods, whether received from her parents or from her husband or otherwise before or after the said marriage, over which goods and jewellery she had and has full power of disposal, receipt whereof the wife hereby acknowledges and now there are no articles, raiments, goods or jewellery whatsoever, belonging to the wife in the possession, custody or control of the husband.

AND it is hereby further declared that all debts incurred by the wife prior to the date of these presents have been paid and liquidated by the husband, a list whereof is attached to this Deed and that the wife shall incur no further debts, nor shall the husband be liable for any debts incurred by the wife subsequent to the date of these presents, in addition to the debts already liquidated; whether the same be for necessities or otherwise [AND IT IS FURTHER AGREED that after the lapse of one year from the date of marriage the parties hereto will present before the District Judge of. . . . . . . .a petition for divorce by mutual consent under the provisions of Section. . . . . .of The. . . . . .Marriage Act, under which said Act their marriage was solemnised and obtain a dissolution of their said marriage].
