Bangladesh (Freedom Fighters) Welfare Trust Order, 1972, a law created for the purpose of refurbishing and remodeling it.

Since the continuation of the work of the Bangladesh Freedom Fighters Welfare Trust, formed under the Bangladesh Freedom Fighters Welfare Trust Order, 1972 (Presidesnt’s Order No. 94 of 1972), and all other freedom fighters, for the welfare of all the warrior freedom fighters and martyred freedom fighters who participated in the Great War of Liberation. The Bangladesh (Freedom Fighters) Welfare Trust Order, 1972 has been refurbished and remodeled. To be thoughtful and necessary;

Therefore, the law is hereby made as follows: –

The first chapter is

introductory

Short title and introduction

  1. (3) This Act shall be called Bangladesh Freedom Fighter Welfare Trust Act, 20.

(2) It shall be effective immediately.

Definition

  1. Unless there is anything repugnant in the subject or context, under this Act-

(1) “title heroic freedom fighter” means the heroic, heroic, heroic hero of the heroic hero, heroic hero or heroic hero because of his heroic contribution to the war of independence;

(2) “Chairman” means the Chairman of the Board of Trustees;

(3) “Trust” means the Bangladesh Freedom Fighter Welfare Trust;

(3) “Trustee” means a member of the Board of Trustees;

(3) “Board of Trustees” means the Board of Trustees constituted under section 4;

(4) “Fund” means the Bangladesh Freedom Fighter Welfare Trust Fund constituted under section 4;

(3) “Executive Committee” means the Executive Committee constituted under section 4;

(4) “Family” means the family of a valiant freedom fighter, a warlike hero freedom fighter, the title of heroic freedom fighter or martyr hero freedom fighter;

(3) “Panguta” means the extent of injuries sustained by the freedom fighter;

(3) “regulation” means the regulations made under this Act;

(3) “Heroic freedom fighter” means the Father of the Nation Bangabandhu Sheikh Mujibur Rahman, who responded to the declaration of independence by taking preparations and internal training in the village-Ganj war and in order to achieve great independence of Bangladesh from March 26 to December 5. Forces and Jamaat-e-Islami and their allies Razakar, Alb All civilians and armed forces, Mujib forces, freedom fighters and other recognized forces, police forces, who have actively participated in the liberation war against the Al-Shams forces. P. And. Naval Commandos, members of the Kilo Flight Ansar Force and the citizens of the following Bangladesh, who will be considered heroic freedom fighters at the time of their age, as prescribed by the Government, namely: –

(A) those who crossed the borders of Bangladesh in order to participate in the liberation war and included their names in various training camps in India;

(B) those Bangladeshi professionals who made special contributions to the liberation war while living abroad during the War of Liberation, and those Bangladeshi nationals who played an active role in the formation of the global community;

(C) those who served as officers or employees or ambassadors of the People’s Republic of Bangladesh (Mujibnagar Government) formed during the War of Liberation;

(D) All those involved in the liberation war and all those involved with the Government of the People’s Republic of Bangladesh (Mujibnagar Government). N. A. (Member of National Assembly) or M. P. A Member of the Provincial Assembly, who was later considered a Member of the Constituent Assembly;

(E) all women (Biranganas) tortured by the Pakistani occupation forces and their allies; However, the age-limit fixed by the government will not apply to undoubtedly proven torture women or heroes;

(F) all the artists and artisans of the Independent Bangla Radio Center and all Bangladeshi journalists who are responsible for the liberation war outside the country and the country;

(G) all players of the independent Bengal football team; And

(h) all doctors, nurses, and medical assistants on the medical team providing medical care to the wounded freedom fighters during the War of Liberation;

(12) “managing director” means the managing director of the trust;

(4) “Rule” means the rules made under this Act;

(3) “War of Liberation” means the freedom of the People’s Republic of Bangladesh against the Pakistani invaders and Jamaat-e-Islami and their allies Razakar, Al-Badr and Al-Shams forces in response to the Declaration of Independence by the Father of the Nation Bangabandhu Sheikh Mujibur Rahman on 7th March, 2 December. ;

(3) “warlike hero freedom fighter” means a freedom fighter whose one or more organs or glands have been damaged during the liberation war;

(3) “martyr hero freedom fighter” means a valiant freedom fighter who participated in the war during the liberation war;

(3) “beneficiary” means –

(a) in the case of a valiant freedom fighter – (a) a heroic freedom

fighter; Or

(ii) his wife or husband in the event of the freedom fighter; Or

(E) the parents of the heroic freedom fighter and his wife or husband in the absence of his wife or husband; Or

(3) the child of the heroic freedom fighter, in the absence of his wife or husband and parents; Or

(e) (i) – (1) the persons of the persons described up to the present, brothers and sisters of the heroic freedom fighter;

(B) in the case of

war-fighting hero freedom fighters – (i) war-fighting hero freedom fighters; Or

(ii) his wife or husband in the event of a freedom fighter freedom fighter; Or

(e) the parent of the heroic freedom fighter in the absence of a war-torn hero and his wife or husband; Or

(4) the child of the warrior freedom fighter, his wife or husband and parents in the absence of the warrior; Or

(a) (i) – (1) the brother or sister of the war- fighting hero freedom fighter in the event of the persons described above;

(C) in the case of the title of gallant warrior –

(i) the title of gallant freedom fighter; Or

(ii) the title of gallant freedom fighter, his wife or husband; Or

(e) the parent of the title heroic freedom fighter, and in the absence of his wife or husband, the title of valiant freedom fighter; Or

(4) the child of the title of heroic freedom fighter, in the absence of his wife or husband and parents; Or

(e) (i) – (1) the brothers and sisters of the title of gallant freedom fighter in the case of the persons described above;

(D) in the case of martyr freedom fighters –

(i) the wife or husband of the martyr freedom fighter; Or

(ii) the parents of the martyr freedom fighter, in the absence of the wife or husband of the martyr freedom fighter; Or

(E) the wife or husband of the martyr freedom fighter and the child of the martyr freedom fighter in the absence of the parents; Or

(3) (a) – (e) in the case of the persons described above, the brothers and sisters of the martyr hero freedom fighter.

(E) (a) – (d) Notwithstanding anything contained in it, the heroic freedom fighters or war-brave hero freedom fighters or the heroes of the valiant freedom fighters or martyrs of the freedom fighters will not be considered beneficiaries under this law unless they are believers in the spirit of liberation war.

Chapter 2

Welfare of the freedom fighters, etc.

Improve the welfare of the freedom fighters

  1. (3) The Government shall take the function of providing honorarium, festival allowance or any other allowance, honorarium or any other benefit for the welfare of the valiant freedom fighters, martyr hero freedom fighters, war heroes and freedom fighters.

(2) The activities under sub-section (1) shall, from time to time, be implemented in the manner prescribed by the order issued by the Government.

Activities related to liberation war ideals and awareness raising

  1. (3) The Government shall take steps to awaken the ideals and consciousness of the War of Liberation among the new generation and preserve the history of the War of Liberation.

(2) The activities under sub-section (1) shall, from time to time, be implemented in the manner prescribed by the order issued by the Government.

Chapter 3

Establishment of Trust, Functions of Trust, and so on

Establishment of trust

  1. (3) For the purpose of this Act, the Bangladesh Freedom Fighter Welfare Trust established under the Bangladesh Freedom Fighters Welfare Trust Order, 1972 (Presidesnt’s Order No. 94 of 1972) shall remain as it has been established under this Act.

(2) The Trust shall be a statutory body and shall have a permanent continuity and a common seal and shall have the power to acquire, hold and transfer both immovable and immovable property subject to the provisions of this Act and may file a suit in its own name. A lawsuit can also be filed against him.

Office of the Trust

  1. (3) The head office of the trust shall be in Dhaka.

(2) The Trust may, with the prior approval of the Government, establish its regional or branch office in any place in Bangladesh, in the interest of the smooth running of its activities.

Functions of the Trust

  1. Article II of clause (17) of sub-clause (b), (c) and (d) mentioned in the beneficiaries of the welfare of the Trust’s functions shall be as follows: –

(a) the Trust economically prosperous and able to Trust-owned movable and immovable property Undertake all activities for development, maintenance and management and acquisition of property;

(B) to provide honorarium, festival allowance or any other allowance, honor or benefit at the rate fixed by the Government;

(C) to provide money, goods or any other assistance prescribed by the Government for the purpose of relief and rehabilitation;

(D) formulation, implementation, maintenance and management of various projects or programs;

(E) to provide necessary medical care, including medications, to the freedom fighters in the war;

(F) establishing a clinic, dispensary or hospital for the special treatment, and the management of it for the purpose of ensuring the medical care of the warring freedom fighters;

(G) to arrange for the rehabilitation and training center for martyrs families and war heroes, and arrange for providing training for them;

(H) to provide education scholarship to the beneficiaries;

(I) the acquisition, retention and transfer of both immovable and immovable property, with the prior approval of the government and transfer and sale;

(J) the formation and management of funds;

(K) accept money, securities, documents or any other immovable property for the trust;

(L) investing in the money and funds of the trust and investing changes when needed;

(D) purchase, sell, endorse, transfer, exchange or complete any such securities approved by the Government;

(3) to execute the contract with any person or local or foreign institution with the approval of the Government and to carry out all necessary documents relating thereto;

(O) To undertake and carry out development activities jointly with local or foreign organizations;

(T) to take any other necessary action to fulfill the purpose of this Act.

Chapter Fourth

Board of Trustees, Executive Committee, and so on

Formation of Board of Trustees

  1. (3) There shall be a Board of Trustees for the management of the Trust and it shall consist of the following members, namely:

(a) the Prime Minister, who shall also be its Chairman;

(B) the Minister or State or Deputy Minister in charge of the Ministry of Liberation War, who shall also be its Vice-Chairman;

(C) four (four) members of parliament nominated by the Prime Minister (their successors will be given priority in the event of heroic freedom fighters or hero freedom fighters);

(D) secretary, finance department, finance ministry;

(E) Secretary, Ministry of Industry;

(F) Secretary, Ministry of Liberation War Affairs;

(G) the Managing Director, who shall also be its Member-Secretary.

(2) The nominated member referred to in clause (c) of sub-section (1) shall remain in office for a period of three (three) years from the date of nomination:

Provided, however, that the Government may, if necessary, exempt the member before the expiry of the term, without showing any reason:

Further, the member may resign his office in the letter signed by the Chairman.

(4) No vacancy in the post of a member or the formation of a Board of Trustees shall not invalidate any of the functions or proceedings of the Board of Trustees, nor shall any question or objection be raised in connection with it.

Functions of the Board of Trustees

  1. The functions of the Board of Trustees shall be as follows: –

(a) The management, monitoring and control of the activities of the Trust as a whole;

(B) taking necessary actions to fulfill the purpose of the trust;

(C) performing any other work for the purposes of this Act; And

(d) to take necessary actions in accordance with the orders and directions issued by the Government from time to time.

Meeting of the Board of Trustees

  1. (4) Subject to the other provisions of this section, the Board of Trustees may determine the procedure of its meeting.

(2) The meeting of the board of trustees shall be convened by the member-secretary, with the consent of the chairman, and shall be held at the place, date and time prescribed by the chairman:

provided , however, that one meeting shall be held every other year:

further, in case of urgent need. A notice of time may be convened by the Board of Trustees.

(4) The Chairman shall preside over all meetings of the Board and in his absence the Vice Chairman shall preside over the meeting.

(3) The presence of three (six) members shall be required for the quorum of the meeting of the Board of Trustees.

(3) Each member shall have one vote in the meeting of the board of trustees, and in the case of equality of votes, the chairman shall have the power to cast a second or decisive vote.

Managing Director

  1. (3) The Trust shall have a Managing Director who shall be the Chief Executive of the Trust.

(2) The Managing Director shall be appointed by the Government and the terms and conditions of his employment shall be determined by the Government.

(3) The Managing Director

shall be responsible for the implementation of all decisions of the Board of Trustees and the Executive Committee – (a) as the full and Chief Executive of the Trust ;

(B) administer the functions and administration of the Trust;

(C) The Board and the Executive Committee shall, from time to time, perform the duties assigned to it.

(4) If the post of managing director becomes vacant or if he is unable to fulfill his duties due to absence, sickness or any other reason, the person appointed by the government is appointed as managing director until the newly appointed managing director takes office or he is able to resume his duties. Employee recruitment

  1. (3) The Trust may appoint the required number of employees as per the organizational structure approved by the Government for the smooth functioning of its functions.

(2) The terms and conditions of employment of employees of the Trust shall be determined by the regulations.

Executive Committee

  1. The Board shall consist of an Executive Committee consisting of the Trustees as follows: –

(a) The Vice-Chairman of the Board of Trustees, who shall also be its Chairman;

(B) the respective four (four) members of the Parliament, nominated by the Prime Minister as Trustees of the Board of Trustees;

(C) the secretary, finance department, finance ministry;

(D) Secretary, Ministry of Industry;

(E) Secretary, Ministry of Liberation War Affairs;

(F) Managing Director, who shall also be its Member-Secretary.

Duties and Functions of the Executive Committee

  1. The duties and functions of the Executive Committee shall be as follows: –

(a) Compliance with the duties, functions and instructions prescribed by the Board, the rules, rules and regulations for the performance of the functions of the Trust;

(B) overseeing the functions of the Trust;

(C) adopt and implement the development plans of all commercial and industrial organizations under the Trust and the Trust;

(D) reviewing the progress of all the plans implemented by the Trust, monitoring the accounts, determining future action plans and determining strategies to implement them; And

(e) implement other decisions made by the Board of Trustees from time to time.

Powers of the Executive Committee

  1. The Executive Committee shall have the power to make decisions regarding the management and expansion of the Trust and all existing industrial entities under it, and to make alternative use decisions by re-launching or developing closed industrial institutions:

provided, however, the Executive Committee shall sell any immovable property of the Trust without the prior approval of the Board of Trustees. Hand over No, one cannot make long-term leases to an organization or make important policy decisions on another matter.

Meeting of the Executive Committee

  1. (4) Subject to the other provisions of this section, the Executive Committee may determine the procedure of its meeting.

(2) All meetings of the Executive Committee shall be held at the place, date and time prescribed by its President:

provided, however, that at least one (one) meeting of the Executive Committee shall be held every two (two) months.

(3) The President shall preside over all meetings of the Executive Committee and shall preside over any meeting of the Trustees nominated by the Trustees in his absence.

(3) Attendance of 5 (five) members shall be required for the quorum of the meeting of the Executive Committee.

The fifth section is the

Trust Fund, Audit, Annual Report and Budget

Funding of the Trust

  1. (3) The trust shall have a fund which will be called Bangladesh Freedom Welfare Trust Fund.

(2) The Fund shall be constituted by the money received from the following sources, namely: –

(a) a grant, aid or grant from the Government;

(B) grants received from any foreign government, international agency, agency, organization or organization, with the prior approval of the Government;

(C) loans taken by the Trust, with the prior approval of the Government;

(D) income from the trust’s property or any activities;

(E) grants made by a local authority, statutory body or any other agency;

(F) grants received from any person, association or institution with the prior approval of the Government;

(G) the fund means the profits earned from the investment;

(H) income from the trust’s own source; And

(I) money received from any other valid source approved by the Board of Trustees.

(4) The money of the fund shall be deposited with a proposed bank and the procedure for withdrawing the money from the bank shall be determined by the rules:

provided that the fund shall be operated in a manner approved by the board of trustees until the rules are made.

Explanation- For the purposes of this section, ‘Tapasli Bank’ means Scheduled Bank as defined in Article 2 (j) of Bangladesh Bank Order, 1972 (PO No. 127 of 1972).

(3) The necessary expenditure of the trust shall be deducted from the fund in accordance with the rules and regulations of the Government.

(3) The bank account of the fund shall be conducted in a manner approved by the Government.

Budget

  1. (3) With the approval of the Executive Committee, the Trust shall submit to the Government the approval of the annual budget statement for the next fiscal year, with its probable income and expenditure within the time specified by the Government, and shall specify the amount of money the Trust may require from the Government in that fiscal year.

(2) After the expiry of each fiscal year, the unspent money from the revenue budget is required to be spent for the welfare of the valiant freedom fighters for the next fiscal year, and with the approval of the finance department, it may be included in the budget statement of the trust for the next fiscal year.

Accounting and Auditing

  1. (3) The Trust shall make a proper accounting of its income and expenditure and shall prepare an annual statement of account.

(2) The Auditor General and the Registrar of Bangladesh, hereinafter referred to as the Auditor General and the Registrar, shall audit the Trust’s account every year and shall send a copy of the Audit Report to the Government and the Trust, and the Trust shall comment on it, if any. To the government.

(3) In the case of the need for auditing under sub-section (2), the Auditor General or any person authorized by him for such purpose may inspect all records, documents, cash or bank deposits, deposits and other property of the Trust and the Board of Trustees. Can interrogate a member or any employee of the trust.

(3) In addition to the audit under sub-section (2), the trust account may be audited by a chartered accountant as defined in Article 2 (1) (b) of Bangladesh Chartered Accountants Order, 1973 (President’s Order No. 2 of 1973) and for this purpose. The Trust may appoint one or more Chartered Accountants and they will be entitled to the rewards fixed by the Government.

(3) The Trust shall, as soon as possible, take steps to remedy any defects or irregularities identified in the audit report.

Annual Report

  1. (3) The Trust shall submit to the Government an annual report containing the details of the activities performed in that year within the next nine (ninety) days after the expiry of the financial year.

(2) The Government may, if necessary, call upon the Trust for any particulars thereof, reports and returns or any other information, and the Trust shall be obliged to submit it to the Government.

Chapter Six

Miscellaneous

Handing over power

  1. The Board of Trustees may, by general or special order, delegate any power conferred upon it under this Act, subject to the conditions set forth in that order, to the Managing Director or any other employee of the Trust.

Ability to make rules

  1. The Government may, by notification in the official Gazette, make rules for the purposes of this Act.

Power to make regulations

  1. For the purpose of this Act, the Board may, with the prior approval of the Government, by notification in the Official Gazette, make such regulations not inconsistent with this Act or Rules.

Eliminate the difficulty

  1. In the event of any ambiguity or difficulty in implementing any provision of this Act, the Government may, by notification in the Official Gazette, remove any such ambiguity or difficulty, subject to conformity with the provisions of this Act.

Cancellation and custody

  1. (3) The Bangladesh Freedom Fighters Welfare Trust Order, 1972 (President’s Order No. 94 of 1972), immediately after the enactment of this Act, then referred to as the Order, shall be canceled.

(2) Notwithstanding the cancellation under sub-section (1), under that order-

(a) any action taken or any action taken or any proceeding taken shall be deemed to have been done, taken or initiated under this Act;

(B) any action or arrangement adopted shall be settled or proceeding in such a way that it is not canceled or canceled;

(C) the funds of the Established Trust, all assets, rights, powers, powers, benefits, immovable and immovable properties, money deposited in cash and banks, and all other related books, registers, record papers, documents, projects and all other types. Claims: Funds, assets, rights, powers, authorities, privileges, properties, finances, registers, documents, projects and claims constituted under this Act. Abe shall be considered;

(D) all debts and liabilities and all contracts executed by or on behalf of or with him, shall be deemed to be the debt and liabilities of the trust established under this Act and the contract performed by or on behalf of him;

(E) the lawsuit or legal proceedings filed against or on behalf of the Trust established thereunder shall be deemed to be a case or legal proceeding filed by or against the Trust established under this Act;

(F) All rules, regulations, any notices issued, any orders, instructions and rules issued, if any, are subject to compatibility with this Act, unless it is newly formulated or promulgated under this Act, or, unless terminated, in force. The Adaptation shall continue to operate, continue and operate as if it had been prepared, issued and granted under this Act;

(G) The existing board, committee, technical committee or other committee or sub-committee, if any, shall continue to function as if it had not been abolished before the expiry of the existing term, as if that board, committee or technical committee was constituted under this Act;

(H) The officers and employees appointed shall remain in the service of the trust on the same terms until the conditions under which they were employed in the service immediately before the commencement of this Act and shall be entitled to pay, allowances and other benefits under the previous rule.

Publish translated text in English

  1. (3) After the enactment of this Act, the Government shall, by notification in the Official Gazette, publish an Authentic English Text translated into English of the original Bengali text of this Act.

(2) In the case of a dispute between the Bengali and the English text, the Bengali text shall prevail.
