Rule—43(8)

It
provides that if the authority concerned fails to take final decision against a
person within 180 working days when the charge has been framed he will be
considered to be exonerated from the charge automatically. But in the instant
case the impugned order was passed after expiry of 720 days. Moreover, no j
second show cause notice or inquiry report was served upon the petitioner in
total disregard to the mandatory provision of law and as such the impugned
dismissal order is illegal and without any lawful authority.
