Section 5—
An appellant is not entitled to the benefit of section 5 of the Limitation Act when his appeal under section 30 of the Special Powers Act is barred by limitation.

Section 5—
The delay in taking the criminal appeal, though inordinate, is condoned in view of the exceptional facts that the appellant, an old woman, after being dispensed with attendance in Court became unaware of her trial and the order of conviction.

Sections 5 & 29(2)—
Application for condonation of delay in filing an appeal under the Special Powers Act is not maintainable. And such an appeal when time—barred cannot be treated as a revisional application under CrPC.

Section 29(2)—
An appellant is not entitled to the benefit of sec. 5 of the Limitation Act when his appeal under sec. 30 of the Special Powers Act is barred by limitation.
