Notice of Suit to a Common Carrier for Damages for Loss of Goods

(Section 10 of the Carriers Act 1865)

Sir

Under instructions from my client Sri ……………… (name, description and address) I call upon you to pay to my said client, within 30 days, from the date of receipt of this notice, a sum of Rs. ……… detailed in the Schedule below, as compensation for the loss of ………… bags of (name the material) which were entrusted to you at your office at Calcutta (etc.) on ………… by M/s. ………………… for carriage for reward through your transport service (state the nature of service) to etc., the consignee being self (or, my client as the case may be), under Con. Note/Despatch Receipt No. ………… dated ……… 2000.

The above loss is due to the misconduct and gross negligence on the part of the aforesaid (name the carrier) and/or their agents and/or employees in due course of employment.

Please take notice that in default of your compliance with this notice a suit will be brought against (name the carrier) for recovery of the said sum of Rs. ………… together with all incidental costs after the expiry of the period hereinabove allowed.
