The Petitioner abovenamed submits—

1. The petitioner and the respondent abovenamed were married at . . . . . . . . . . . according to the Hindu rites on . . . . . . . . . . The marriage was not registered. There is no issue of the said marriage.

2. The parties to the marriage aforesaid lived and cohabited at . . . . . . . . . . after marriage until . . . . . . . . . . .

3. The respondent at the time of marriage was a perfectly healthy young man and remained so until about . . . . . . . . . . . when he contracted venereal disease of syphilis from a source unknown to the petitioner. The respondent did not disclose it to the petitioner despite enquiry. The petitioner submits that the respondent acquired the said disease as a result of adultery committed by the respondent in or about . . . . . . . . . . .

4. The respondent kept his venereal disease a secret and thus exposed her to the danger of infection of the dangerous venereal disease and thereby committed cruelty on the petitioner.

5. That it was in the first week of . . . . . . . . . . . when the respondent became seriously ill as a result of some antibiotic injection that the petitioner discovered that the respondent was suffering from a venereal disease and thereafter she refused him marital intercourse receiving the advice from her physician.

6. The respondent insists on sexual intercourse with the petitioner despite the fact that his blood reports do not disclose him free from the disease. The petitioner’s resistance to the respondent’s sexual advances infuriated the respondent and he was violent to the petitioner by slapping her twice on . . . . . . . . . . . when the respondent was under the influence of alcohol. That the petitioner remained in constant fear of molestation by the respondent and consequent danger of the disease in the months of . . . . . . . . . . .and the dread has adversely affected her health. In these premises as well the respondent committed cruelty on the petitioner.

7. In view of the fact that the respondent is suffering from a venereal disease in a communicable form from a source other than the petitioner she is entitled to a decree of dissolution of marriage.

8. This Court has jurisdiction to entertain and adjudicate this petition because the parties were married in . . . . . . . . . . .

9. There is no collusion between the parties to the petition for these proceedings or otherwise.

The petitioner, therefore, prays that her marriage with the respondent be dissolved by a decree for divorce.
