Rule—73

Pourashava election—Election
Commissions power to direct re-poll in Pourashava election—Election Commission
has power to direct re-poll in appropriate circumstances and such power has
been conferred by law for a free and fair election —Paurashava Election Rule is
in identical term of the Union Parishad Election Rule—Controversial points
which were disputed questions of fact involving Union Parishad Election Rule
could be decided. It had been held in earlier judgments, on evidence by the
Election Tribunal—The High Court Division has therefore erred in setting aside
the order of re-poll by the Election Commission.
