Surrender of Lease (by a separate deed)
THIS DEED OF SURRENDER is made on the . . . . . . day of . . . . , 20. . . BETWEEN A. B. etc. (hereinafter called ‘‘the Lessee’’) of the one part AND C.D. etc. (hereinafter called ‘‘the Lessor’’) of the other part.
WHEREAS the Lessor granted to the Lessee a. . . . . . . .years’/perpetual lease of the land mentioned in the Schedule hereto on an annual rent of Rs . . . . . . . .;
AND WHEREAS the Lessee has agreed with the Lessor to surrender to him the said land by relinquishing all the rights and interests which the Lessee holds in respect of the same under the lease hereinbefore recited in consideration of a sum of Rs . . . . . . . .
NOW THIS DEED WITNESSES as follows:
1. In pursuance of the aforesaid agreement and in consideration of the sum of Rs . . . . . . . . paid by the Lessor to the Lessee (the receipt of which the Lessee hereby acknowledges) the Lessee hereby surrenders and yields up to the Lessor the property mentioned in the Schedule hereto and demised by the lease hereinbefore recited with all the appurtenances thereto belonging, and agrees that the said term/perpetuity created by the said lease and all the estate and interest of the Lessee in the said property under or by virtue of the said lease may be absolutely and forever extinguished from the date hereof and the said property may revert to the Lessor.
2. The Lessee hereby releases the Lessor from all obligations arising under the said lease.
