An Act to establish a university called Sylhet Medical University for the expansion and development of higher education, research and service quality and facilities in the medical field of the country.

As it is expedient and necessary to establish a university called Sylhet Medical University for the higher education, research and service and medical facilities in the medical field of the country and to extend the facilities;

That is why it was legislated as follows:

Short title and introduction

  1. (3) This Act shall be called Sylhet Medical University Act, 20.

(2) It shall come into force on the date on which the Government determines, by notification in the Official Gazette.

Definition

  1. Unless there is anything repugnant in the subject or context, under this Act-

(1) ‘affiliated medical college or institute’ means any medical college or institute recognized and affiliated by the University in accordance with this Act, Statute and Rules;

(2) ‘faculty’ means any faculty of the University;

(3) ‘Academic Council’ means the Academic Council of the University;

(3) ‘Institute’ means any Institute recognized or established by the University;

(4) “Authority” means any authority of the University;

(3) ’employee’ means any employee of the University;

(3) ‘Treasurer’ means the Treasurer of the University;

(3) ‘Chancellor’ means the Chancellor of the University;

(3) “medical assistant” means a person who is specially trained and certified in health care activities and responsible for patient care;

(3) ‘nurse’ means a nurse certified by the Bangladesh Nursing and Midwifery Council;

(3) ‘Dean’ means the Dean of a Faculty;

(12) “Chief Engineer” means the Chief Engineer of the University;

(3) ‘Regulation’ means the regulations made under this Act;

(3) ‘Provost’ means the head of a student’s residence;

(3) ‘Pro-Vice-Chancellor’ means the Pro-Vice-Chancellor of the University;

(3) ‘Rule’ means the rules made under this Act;

(4) ‘Department’ means any department of the University;

(4) “University” means the Sylhet Medical University established under section 4;

(4) “Vice-Chancellor” means the Vice-Chancellor of the University;

(20) ‘Grant Commission’ means the University Grants Commission of Bangladesh, formed under the University Grants Commission of Bangladesh Order, 1973 (President’s Order No. 10 of 1973);

(20) ‘Grant Commission Order’ means the University Grants Commission of Bangladesh Order, 1973 (President’s Order No. 10 of 1973);

(22) ‘Registrar’ means the Registrar of the University;

(27) ‘Teacher’ means a University Professor, Associate Professor, Assistant Professor, Lecturer and any person recognized as a teacher by the University;

(21) ‘student’ means any student registered in the regular education program of the University;

(20) ‘Student residence’ means a student residence under the management and maintenance of the University for the integrated life and co-curricular teaching of the students of the University;

(20) ‘Syndicate’ means the Syndicate of the University;

(25) ‘Statute’ means the Statute made under this Act;

(23) ‘Organization’ means any institution of the University.

Establish University

  1. (3) A University named Sylhet Medical University shall be established in the city of Sylhet or at any other place designated by the Government, in accordance with the provisions of this Act.

(2) A statutory body shall be composed of Sylhet Medical University, consisting of University Chancellor, Vice-Chancellor, Pro-Vice-Chancellor, Treasurer, Syndicate and Academic Council.

(3) The University shall have a permanent continuity and a general seal and, subject to the provisions of this Act, it shall have the power to acquire, hold and transfer both immovable and immovable property, and may file a lawsuit in its own name and may also be sued against it.

Jurisdiction

  1. The University shall exercise all the powers conferred on it by this Act or the rules, regulations and statutes made thereunder.

Power of the University

  1. Subject to the provisions of this Law and Grant Commission Order, the University shall have the following powers, namely: –

(1) to arrange post-graduate studies in any field of medical science, especially, education and research in any subject of modern medical science and technology;

(2) to arrange for undergraduate and postgraduate studies in nursing;

(4) to arrange for graduate and postgraduate studies of medical assistants;

(4) To set the syllabus for the teaching of the University and affiliated medical colleges or institutes;

(3) to take tests, assessments and degrees and other academic honors for persons who have completed their studies in the prescribed curriculum of the University and have completed the research work in accordance with the terms and conditions of the statute;

(3) issue certificates to students of an affiliated medical college or institute;

(3) to confer an honorary degree or other honor upon a person in special cases in accordance with the constitution;

(3) to arrange lectures and education for the purpose of issuing prescribed diplomas and certificates for the persons who are not students of the University or the Institute, and to provide them with diplomas or certificates;

(3) To undertake collaborative research, joint research and joint degree programs with other universities and authorities at home and abroad in the prescribed way, for the need of the University;

(4) Subject to the conditions prescribed by the Grant Commission, the creation of the posts of Professors, Associate Professors, Assistant Professors, Lecturers and any other research teacher and staff required by the University, and the appointment of such persons by the approval of the Chancellor to the persons recommended by the Election Board;

(3) establishing and maintaining student accommodation for the students of the University;

(12) to introduce fellowships, scholarships, medals and other awards as the University considers worthy of merit recognition;

(3) to establish and maintain academic museums, laboratories, workshops and institutes for the promotion of education and research, with the approval of the Chancellor;

(3) publish books and journals for the promotion and advancement of education and research, and create opportunities for the use of information and technology;

(3) to supervise and regulate the moral and academic discipline of the teachers, staff and students of the University, to develop curriculum support programs and to improve their health;

(3) to demand and collect fees prescribed by the rules;

(3) to subscribe to or cancel any affiliation with any medical college, dental college, nursing college or institute, and to give recognition to any medical educational institution abroad, subject to the provisions of section 4;

(3) to train physicians, nurses and medical assistants for all postgraduate degrees;

(3) To receive grants, contributions and scholarships from local or foreign persons or institutions, and to form trusts, etc., with the permission of the Commission and the Government, to allow the expansion and development of the education of the University;

(20) to engage in a contract to achieve the goals of the University, to implement the contract, to change the terms of the contract or to terminate the contract;

(20) To carry out the necessary ancillary functions to fulfill the purpose of the University as a teaching and research institution.

The university is open to all

  1. The University will be open to all, irrespective of race, religion, caste, tribe or gender.

University teaching

  1. (3) All recognized educational and research activities relating to the examination of the University shall be conducted by the University and shall include all lectures and works of the laboratory or workshop.

(2) Teachers shall conduct teaching in the manner prescribed by the Statute.

(4) The syllabus and curriculum shall be prescribed according to the constitution and rules.

(3) The University may arrange teaching with a medical college, dental college or institute or any other university on mutual assistance.

Inspection by the Grant Commission

  1. (3) The Grant Commission may inspect the examination, teaching and other activities conducted by the University and its buildings, libraries, laboratories, machinery or auxiliary institutions and the University by a committee composed of one or more persons and may investigate any other matter of the University in the same manner.

(2) The Granting Commission shall, on the occasion, give notice to the University regarding the purpose of each inspection or investigation and shall have the right to represent the University in such inspection and investigation.

(4) The Commission shall inform the Commission of its inspection or inquiry referred to in sub-section (2), and advise the University to take necessary steps in connection with it and the report of the arrangements taken by the University shall be forwarded to the Commission for approval.

(3) The University shall maintain the registrars and documents prescribed by the granting commission and shall provide reports, statistics and other information as required by the Commission.

Employees

  1. The following shall be employees of the University, namely: –

(a) the Vice-Chancellor;

(B) the Pro-Vice-Chancellor;

(C) the Treasurer;

(D) the Registrar;

(E) the Dean;

(F) Proctor;

(G) the Provost;

(H) the librarian;

(I) the test regulator;

(J) Director (Planning and Development);

(K) Director (Finance and Accounting);

(L) director (hospital);

(D) Chief Engineer;

(3) Other employees declared by the Statute as University employees.

Chancellor

  1. (3) The President of the People’s Republic shall be the Chancellor of the University of Bangladesh.

(2) The Chancellor or any person nominated by him shall preside over the commemoration of the award of academic degree and honorary degree of the University.

(3) The Chancellor shall be entitled to the powers conferred by this Act and the Statute.

(3) Every proposal for awarding honorary degrees shall have the approval of the Chancellor.

(3) If it is satisfactorily to the Chancellor that an unusual situation exists as a serious disruption to the normal functioning of the University, in that case, he may issue necessary orders or instructions for the continuation of the normal activities of the University, and similar orders or instructions for the authorities, teachers and staff. Appointment of Vice-Chancellor

  1. (1) The Chancellor shall, on the prescribed terms from among the University Professors, or any person having sufficient experience in teaching in medical science, by notification in the Official Gazette, appoint the Vice-Chancellor for a term of four (four) years, provided that any person shall be 2 consecutively (2) Do not appoint more than ten Vice-Chancellor.

Power and responsibility of the Vice-Chancellor

  1. (3) The Vice-Chancellor shall be the Academic and Chief Executive of the University, and he shall be the Chairman of the Syndicate, Academic Council and Planning and Development Committee.

(2) The Vice-Chancellor shall be responsible to the Chancellor in carrying out his duties.

(3) The Vice-Chancellor shall faithfully comply with and enforce the provisions of this Act, Statutes, Rules and Regulations and may exercise such other powers as may be prescribed.

(4) The Vice-Chancellor may attend any meeting of any authority or institution of the University and participate in its functions, but he may not vote for it unless he is a member.

(3) The Vice-Chancellor shall convene a meeting of the Syndicate, the Academic Council and the Planning and Development Committee, and take effective measures for the implementation of the decision.

(4) The Vice-Chancellor shall be responsible to the Syndicate for the operation of the University in accordance with these laws, statutes, rules and regulations.

(3) The Vice-Chancellor may, if deemed necessary, delegate any of his powers and responsibilities to any University employee, with the prior approval of the Syndicate.

(3) The Vice-Chancellor shall execute the Syndicate’s decision on the appointment, dismissal or temporary dismissal of the teachers and the persons referred to in section 4 and take disciplinary action against them.

(3) The Vice-Chancellor shall have general control over the teachers and staff of the University.

(4) The Vice-Chancellor may, on the occasion of the Syndicate, appoint any teacher other than the Professor, the Assistant Professor and the Assistant Professor, and any other employee, except the Pro-Vice-Chancellor and Treasurer, for a maximum of six (six) months in a vacant position. Appointment period may be extended up to 6 (six) months:

Provided that the appropriate authority No such appointment shall be made on any such terms which have not been approved by the Authority:

Provided further that, if the appointment is not made regularly within the extended period, the appointment shall be deemed to have been terminated at the end of that term.

(4) If an emergency situation arises in the management of the University and it is deemed necessary to take immediate action with respect to the Vice-Chancellor, he may take such action and the employee, authority, or institution generally able to take action on the matter, to that employee, authority or institution. , As soon as possible, about the measures taken Karibena well-being.

Pro-Vice-Chancellor

  1. (3) The Chancellor shall, on such terms as may be appointed from the regular working professors of the University, by notification of the Government Gazette, for a period of four (four) years, appoint a maximum of two (two) Pro-Vice-Chancellors.

(2) The Pro-Vice-Chancellor shall exercise the powers and perform the duties assigned by the Vice-Chancellor, as determined by the Statutes, Rules and Regulations.

Treasurer

  1. (3) The Chancellor shall, by notification in the Official Gazette, appoint a professor who is regularly employed at the University or a suitable person nominated by the Government for the terms and conditions prescribed by the University Treasurer.

(2) If the post of Treasurer becomes vacant for leave, illness or any other reason, the Syndicate shall immediately notify the Chancellor of the matter and shall take the measures which it thinks necessary to perform the functions of the Chancellor Treasurer.

(3) The Treasurer shall oversee the funding of the University and advise on its finance policy.

(3) The Treasurer shall, under the control of the Syndicate, administer the property and investments of the University, and he shall be responsible for the submission of annual budget and accounting statements.

(3) The Treasurer shall be liable, subject to the power conferred by the Syndicate, to see that the money for which the money is allocated or allocated is spent in that sector.

(3) The Treasurer shall sign all financial agreements on behalf of the University.

(3) The Treasurer shall exercise other powers as determined by the Statutes, Rules and Regulations.

Registrar

  1. The Registrar shall be the resident employee of the University and he shall –

(a) maintain the University documents and general seals and shall be the caretaker of all other University property, as assigned by the Syndicate;

(B) sign on behalf of the University in contracts other than financial agreements;

(C) exchange all office-related correspondence on behalf of the University;

(D) shall serve as the secretary of the Syndicate and the Academic Council;

(E) maintain links with the Deans about their plans, programs and schedules; And

(f) perform such other duties as may be assigned from time to time by the Academic Council and the Syndicate or by the Vice-Chancellor.

The test regulator

  1. The test regulator shall be in charge of all matters related to conducting the examination and shall perform such other duties as may be prescribed by the Statutes, Rules and Regulations and assigned by the Vice-Chancellor.

Recruit other employees and their powers and responsibilities

  1. The Syndicate shall determine, by statute, the method of appointment and the duties and powers of all the employees of the University who are not mentioned in any provision of this Act.

Authority

  1. The University shall have the following authority, namely: –

(a) Syndicate;

(B) the Academic Council;

(C) the faculty;

(D) Curriculum Committee;

(E) the Board of Advanced Studies;

(F) finance committee;

(G) the Planning and Development Committee;

(H) the Board of Elections;

(I) the Ethics Committee;

(J) the Disciplinary Board;

(K) the attached hospital management committee of the university; And

(l) other authorities as stipulated in the Statute.

Syndicate

  1. (3) The Syndicate shall consist of the following members, namely: –

(a) the Vice-Chancellor, who shall also be its Chairman;

(B) two (two) members of the National Parliament nominated by the Speaker of the Parliament;

(C) Pro-Vice-Chancellors;

(D) a representative nominated by the Vice-Chancellor of Bangabandhu Sheikh Mujib Medical University;

(E) the Treasurer;

(F) all Deans;

(G) from the professors, associate professors, and assistant professors, (1) the members elected by the vote of their own level teachers of the University;

(H) two (two) persons nominated by the Chancellor, who are members of a research institute or have made valuable contributions to the medical field;

(I) 3 (one) members of the Academic Council nominated by the Chancellor;

(J) a full-time member of the University Grants Commission;

(K) Divisional Commissioner, Sylhet;

(L) the Director General, Directorate of Health;

(E) a representative of the rank of Additional Joint Secretary of the Department nominated by the Department of Health Education and Family Welfare, Ministry of Health and Family Welfare;

(4) a representative of the rank of Additional Joint Secretary of the Department nominated by the Secondary and Higher Education Department, Ministry of Education;

(O) a representative of the rank of additional joint secretary of the department nominated by the Finance Department;

(D) two (two) principals nominated by the Chancellor from amongst the principals of the affiliated medical college;

(L) a representative who is not below the president of the Bangladesh Medical Association or vice-president nominated thereafter;

(D) a representative who is not below the president of the Bangladesh College of Physicians and Surgeons or vice-president nominated thereafter;

(D) a representative who is not below the President of the Bangladesh Medical and Dental Council or vice-president nominated thereafter;

(N) the President of the Federal Union of Bangladesh or a representative nominated by him; And

(p) the Registrar, who shall also be its Secretary.

(2) Any nominated member of the Syndicate shall hold office for a term of two (two) years from the date of nomination:

Provided that he shall remain in office till his replacement member takes office despite the expiry of the term:

Further, if a person is a member of the Syndicate as a university teacher, dean, member of the academic council or president of a association or union or member or public servant, he shall remain as long as the corresponding teacher, dean, president, member or public servant. , So long as the member of the Syndicate holds office.

(3) No nominated member of the Syndicate shall be nominated for more than two (two) consecutive terms.

Powers and responsibilities of the Syndicate

  1. (4) The Syndicate shall be the chief executive authority of the Universities and shall have the power of general management and supervision of the Syndicate on the functions, institutions and property of the Universities, subject to the provisions of this Law and Grant Commission order and the powers conferred upon the Vice-Chancellor, and these laws, statutes, rules and regulations and regulations. (2) Notwithstanding the totality of sub-section (1), the Syndicate shall perform the following duties, namely: –

(a) Acquisition and funding, possession, and control and management of University property;

(B) to consider and make decisions on the annual report of the University, the annual calculations and the annual probable expenditures;

(C) to consider the advice of the Finance Committee on finance;

(D) to determine the size of the general seal of the University and to arrange for its custody and use;

(E) a full particulars of the financial needs of the University, including the full particulars of all wills received by the University, are submitted to the Grant Commission every year;

(F) to manage any funds provided to the University for general or special purposes;

(G) if there is no other provision in this Act or the Statute, appoint teachers and other employees of the University and determine their duties and terms of service;

(H) acceptance of wills, donations and other legally transferred immovable or immovable property on behalf of the University;

(I) arrangements for the examination of the University and the publication of its results;

(J) subject to the power of the Vice-Chancellor, as assigned by this Act, to determine and regulate all matters relating to the University in accordance with the Statutes and Rules;

(K) with the approval of the Chancellor, subject to the provisions of this Law and Grant Commission Order, to make rules and constitution and amend it as required;

(L) create, temporarily suspend or abolish the posts of professors, associate professors, assistant professors, lecturers and other teachers and researchers, according to the constitution and with the approval of the Academic Council, with the approval of the Commission and the Government;

(D) abolish or temporarily suspend any department or institute in accordance with the Statute and on the recommendation of the Academic Council;

(3) to recognize a scholar as a university teacher in accordance with the constitution and on the recommendation of the Academic Council;

(O) subject to the conditions prescribed by the regulations and upon the recommendation of the Vice-Chancellor, to delegate his powers to the appropriate authority;

(T) to exercise and fulfill the other powers conferred by this Act and the Statutes;

(L) to exercise such other powers of the University, which have not been granted to any other authority under this Act or the Statute.

Academic Council

  1. (3) The Academic Council shall consist of the following members, namely: –

(a) the Vice-Chancellor, who shall also be its Chairman;

(B) the Pro-Vice-Chancellors

(c) the Treasurer;

(D) all deans;

(E) a professor nominated by the Vice-Chancellor, Bangabandhu Sheikh Mujib Medical University;

(F) two (two) persons nominated by the Chancellor from renowned medical scientists;

(G) heads of all departments;

(H) 4 (four) principals nominated by the Chancellor from among the principals of the affiliated medical colleges;

(I) two (two) directors nominated by the Chancellor from among the Directors, if any, of the affiliated Post Graduate Medical Institutes;

(J) Director (Medical Education and Health Manpower Development), Directorate of Health; And

(K) the Registrar, who shall also be its Secretary.

(2) Any nominated member of the Academic Council shall remain in office for a term of two (two) years from the date of nomination:

provided that he shall remain in office until his replacement member takes office after expiry:

Powers and Responsibilities of the Academic Council

  1. (3) The Academic Council shall be the principal educational authority of the University.

(2) Subject to this Act, Statute and Regulation, the Academic Council shall be responsible for maintaining the quality of all education and examinations of the University and its affiliates, and shall have the power to control and over all such matters.

(3) The Academic Council may, subject to the powers of this Act, the Grant Commission Order, the Statute and the Vice-Chancellor and the Syndicate, make rules for the determination of the proper standards for teaching and curriculum and teaching, research and examination.

(3) Subject to the powers conferred on the Vice-Chancellor and the Syndicate, the Academic Council shall have the following powers, namely: –

(a) to advise the Syndicate on all educational matters;

(B) make recommendations to the Syndicate in connection with the provision of educational provisions;

(C) summon the report from the persons engaged in the study and recommend it to the Syndicate;

(D) determining the conditions under which students should be exempted from any participation in the examination;

(E) to submit a plan to the Syndicate for the formation of the Department and Curriculum Committee of the University;

(F) to provide teaching and research in the University and to arrange for their development;

(G) subject to the approval of the Syndicate, to make the syllabus and schedule of each examination subject to the recommendation of the faculty and to determine the content of the study;

(H) Postgraduate and Ph.D. To approve or reject a candidate’s thesis for a degree, subject to consideration of the Ethics Committee and the Board of Advanced Studies;

(I) recognition of the same degree as the equivalent examination, if the examination of the other university is completed on the same scale as the University;

(J) to advise the Syndicate on any new development proposals for teaching and research at the University;

(K) to formulate and amend rules relating to the use of the University Library;

(L) recommending the research development of the University and advising the Syndicate on other matters related to the education transmitted to it;

(D) the establishment of a new faculty or department and the submission of new subjects to the research and museum of a faculty for consideration of the Syndicate;

(4) To consider the proposal for the creation, temporary suspension or termination of the post of Professor, Assistant Professor, Assistant Professor, Lecturer or other teacher, and to submit a recommendation to the Syndicate.

(3) The Academic Council shall exercise and discharge the other powers conferred upon it by the Statute.

The faculty

  1. (3) The University shall have the following faculties, namely: –

(a) Faculty of Medicine;

(B) the Faculty of Surgery;

(C) Faculty of Basic Science and Para-Clinical Science;

(D) the Faculty of Dental;

(E) the Faculty of Nursing;

(F) Faculty of Bio-Technology and Bio-Medical Engineering;

(G) Faculty of Medical Technology;

(H) Faculty of Preventive and Social Medicine.

(2) Except for the faculty referred to in subsection (1), any other faculty of medical and research shall be subject to the provisions of rules and statutes and may be constituted with the approval of the Academic Council’s recommendation and syndicate.

(4) Subject to the control of the Academic Council, each faculty shall be in charge of teaching and conducting research on specific matters under the constitution and rules.

(3) The composition of the Faculty and its powers and functions shall be determined by the Statutes and Rules.

(3) Each faculty shall have one Dean and shall be responsible for the compliance of the Statutes, Rules and Regulations relating to the Faculty under the supervision of the Vice-Chancellor.

(3) The Dean of each faculty shall be selected by the teachers of all departments comprising the respective faculties.

Section

  1. (4) Every subject that is taught in the University shall be treated as one department.

(2) A teacher shall be the head of the department for a period of three (three) years on the basis of seniority from the professor and associate professors of the subject concerned, and he shall be responsible for the planning and coordination of the functions, subject to the control and general supervision of the Vice-Chancellor and Dean.

Curriculum Committee

  1. Each faculty shall have a curriculum committee set by the constitution.

Board of Advanced Studies

  1. There shall be a Board of Advanced Studies for the education and research system of the University and it shall be constituted in the manner prescribed by the Statute.

Finance Committee

  1. (3) The Finance Committee shall consist of the following members, namely: –

(a) the Treasurer, who shall also be its Chairman;

(B) one (1) Syndicate member nominated by the Syndicate, who is not employed by the University;

(C) Pro-Vice Chancellors;

(D) a Dean nominated, in turn, by the Academic Council;

(E) a professor of the University nominated by the Syndicate;

(F) a representative who is not below the rank of joint secretary nominated by the Government;

(G) an accountant nominated by the Chancellor;

(H) the Registrar;

(I) a representative of the University Grants Commission;

(J) The Director of the University (Finance and Accounting), who shall also be its Secretary.

(2) The nominated members of the Finance Committee shall hold office for two (two) years:

Provided that, despite his expiration, he shall remain in office until his replacement member takes over.

(4) The Finance Committee shall –

(a) oversee the income and expenditure of the University;

(B) advise the Syndicate on the annual budget consideration of the University and so on;

(C) advise the Syndicate on all matters relating to the disposal of money, funds, resources and accounting of the University; And

(d) perform such other duties as may be determined by the Statute or given by the Vice Chancellor and the Syndicate.

Planning and Development Committee

  1. (3) The Planning and Development Committee shall consist of the following members, namely: –

(a) the Vice-Chancellor, who shall also be its Chairman;

(B) Pro-Vice Chancellors;

(C) the Treasurer;

(D) the Vice-Chancellor, in turn, nominates two (two) Deans of the Faculty;

(E) one of its members nominated by the Syndicate;

(F) such an architect and an economist nominated by the Government not in the affairs of the University;

(G) a representative who is not below the rank of joint secretary nominated by the Government;

(H) Chief Engineer; And

(i) the Director (Planning and Development), who shall also be its Secretary.

(2) Any nominated member of the Planning and Development Committee shall hold office for a period of two (two) years from the date of nomination:

Provided that, despite his expiration, he shall remain in office until his replacement member takes over.

(3) The Planning and Development Committee shall prepare the development plan of the University and submit it to the Syndicate for approval.

Board of Elections

  1. (3) There shall be one or more Election Boards for the appointment of teachers and staff of the University.

(2) The composition and functions of the Board of Election shall be determined by the Statute.

(4) Unless the syndicate agrees with the recommendation of the Board of Elections, the matter must be forwarded to the Chancellor for a final decision and in that case the decision of the Chancellor shall be final.

Ethics Committee

  1. (3) There shall be an Ethics Committee for the evaluation, monitoring and other activities of the various research activities of the University.

(2) The composition and functions of the Ethics Committee shall be determined by the Statute.

Discipline Board

  1. (3) The University shall have a Disciplinary Board.

(2) The composition, powers and functions of the disciplinary board shall be determined by the constitution or rules.

Hospital Management Committee

  1. (3) The Hospital Management Committee shall be constituted with the following members, for the purpose of improving the management and medical services of the hospitals affiliated with the University, namely: –

(a) a Pro-Vice-Chancellor nominated by the Vice-Chancellor, who shall also be its Chairman;

(B) three (three) teachers nominated by the Vice Chancellor from among the teachers of the University;

(C) Joint Secretary (Hospital), Department of Health Services, Ministry of Health and Family Welfare;

(D) the department director (health);

(E) Deputy Commissioner, Sylhet;

(F) the Registrar;

(G) two (two) syndicate members who are not teachers of the university nominated by the syndicate;

(H) Director (Hospital), Health Department;

(I) the director of the university (planning and development);

(J) Nursing Superintendent of Hospital;

(K) Chief Engineer;

(L) The Director (Hospital) of the University, who shall also be its Secretary.

(2) Any nominated member of the Hospital Management Committee shall hold office for a term of two (two) years from the date of nomination:

provided that he shall remain in office until his replacement member takes office despite the expiry of his term.

(3) The responsibility of the Hospital Management Committee shall be as follows: –

(a) Hospital management;

(B) assigning responsibility to hospital employees, ensuring rules and supervision;

(C) the provision of services for hospital patients;

(D) Pharmaceuticals, m. S. And. Confirmation of supply and distribution;

(E) feeding and feeding the patient;

(F) maintenance and monitoring of hospital equipment;

(G) ensuring cleanliness of the hospital;

(H) Ensure water, electricity, gas, telephone, security and other facilities.

Other authorities of the University

  1. The constitution shall constitute other authorities of the University and determine their powers and responsibilities.

Appointment of teachers

  1. The teacher shall be appointed in the manner prescribed by the Statute.

Terms of service

  1. (3) Every salaried teacher and employee of the University shall be appointed by written agreement on the basis of merit and merit, the contract shall be reserved to the Registrar of the University and a copy shall be provided to the concerned teacher or employee.

(2) A salaried teacher or employee of the University shall resign from the job of the University as a Member of Parliament or before contesting an election in a local government institution.

(4) A salaried teacher or employee of the University may be removed from his job or removed from service in the manner prescribed by the Statute or Rules for any negligence, misconduct, demoralization or inefficiency in his duties:

Provided, however, that the charges brought against him shall not be removed or dismissed or any other form of punishment shall be taken until the inquiry is conducted by an inquiry committee and without the opportunity of self-defense, either personally or through a representative.

The responsibility of the teachers

  1. (3) The teachers of the University shall be constantly engaged.

(2) The responsibility of the teachers shall be as follows: –

(a) To teach the students through lectures, tutorials, talks, seminars, hands-on exhibits and workshops;

(B) conducting and supervising the research;

(C) keeping in contact with the students in private, giving them guidance and supervising their activities;

(D) assisting the authorities in organizing the curriculum and syllabus of the University and its faculties and other co-educational institutions, in setting and conducting examinations, in evaluating test papers and research papers and in organizing libraries, laboratories, and other educational and co-educational activities;

(E) to carry out the duties of treating patients of the University Hospital;

(F) To take a leading role and contribute to any epidemic and national disaster.

Accommodation

  1. (3) Every student of the University shall reside in the hall or place and condition prescribed by the Statutes and Rules.

(2) The residence of the student of the University shall be determined by the Constitution.

(3) The Provost, Supervisor, Employee of the Student Residence and their duties shall be determined by the Statute.

Syllabus

  1. The faculty will create the syllabus by a full committee or subcommittee and send it to the Academic Council for approval.

Admission to university courses

  1. (4) Subject to this Act and the Statute, the admission of the student in any matter of medical science at the University, undergraduate and postgraduate and other courses in the University shall be governed by the principles laid down by the admission committee of the Academic Council.

(2) No person shall be admitted to the postgraduate course of the University unless there is a bachelor’s degree from a medical college or a medical institution recognized by the University and Bangladesh Medical and Dental Council.

Test

  1. Under the general control of the Vice-Chancellor, the test-regulator shall take all measures to conduct the examination in accordance with the constitution or rules.

Testing method

  1. (3) All examinations of the University shall be conducted in the manner prescribed by the constitution or rules.

(2) An accreditation committee shall be constituted by the constitution for the control of the standard of examination and training.

University funding

  1. (3) The Sylhet Medical University Fund shall have a University Fund and shall deposit the following money, namely: –

(a) allotment or grant from the Government and Grant Commission;

(B) salaries, fees, etc. paid by the student;

(C) proceeds from the affiliated hospital of the University;

(D) the income or profit from all the property vested in the University and maintained by it;

(E) income or profit from investment in University money;

(F) grants made by a local, foreign institution, authority or person;

(G) the various fees, charges, etc., as may be prescribed by the University;

(H) money received from other sources vested in the University at the behest of the Government;

(I) grants received from alumni; And

(J) money received from other legitimate sources.

(2) The money of the Fund shall be deposited with the Bank, as prescribed by the Syndicate, and the funds may be withdrawn from the Fund in the manner prescribed by the Statute.

(3) All necessary expenses of the University shall be deducted from the Fund.

(4) A portion of the Fund may be invested in the manner prescribed by the Statute.

(3) The University may take necessary measures for the formation and use of the Trust by a grant from a local or foreign institution, authority, person or alumni.

(3) The University may constitute a separate fund for a specific purpose and may operate such fund in the manner prescribed by the Statute.

Annual Report

  1. The annual report of the University shall be prepared in accordance with the Syndicate directive and it shall be submitted to the Commission before the end of the next academic year.

Accounting and Auditing

  1. (3) The annual calculation and balance sheet of the University shall be prepared in accordance with the directions of the Syndicate and shall be audited by the designated authority of the Commission.

(2) The copy of the Annual Audit Report shall be submitted to the Commission for approval.

Disputes about the structure of authority

  1. If any question arises concerning the right of a person to be a member of a university authority in the absence of such provision in this Act, Statute or Rule, it shall be forwarded to the Chancellor and in this case the decision of the Chancellor shall be final.

Formation of committees

  1. If this Act or Statute empowers an authority to constitute a committee, such authority may, with the approval of the Syndicate, make such a committee as may be determined by any of its members and other persons as may be required.

Not to invalidate the proceedings due to vacancies etc.

  1. No action or proceeding of any authority of a University shall be invalid only on account of vacancy in any of its members or failure of appointment, nomination or election, or any other error concerning the formation of that authority, nor shall any question be raised in connection with it.

Right to appeal

  1. In the event of a dispute between the University and any of its teachers or staff on any matter or contract which is not specifically stipulated in this Act or Statute, the matter shall be sent by the Vice-Chancellor to the Chancellor for a decision on the request of the teacher or employee and in this case the decision of the Chancellor shall be final. .

Retirement and Future Funds

  1. Subject to the procedures and conditions laid down by the Statute, the University may arrange for the welfare of its teachers and employees, with the prior approval of the Government, to create pension, joint insurance, welfare fund or provident fund or to provide gratuity or gratuity.

Special provisions regarding affiliation

  1. (3) Notwithstanding anything contained in any other law or legal document for the time being in force, all Government and all affiliated to the University of Shahjalal Science and Technology established under the Shahjalal Science and Technology University Act, 1 (Act 1 of 3). Private medical college, dental college, nursing college or institute or any other medical institution Will be

(2) All Government and Private Medical Colleges, Dental Colleges, Nursing Colleges or Institutes or any other medical institution under the Sylhet Division shall be affiliated to the University, unless a different decision is taken by the Government, without affecting the totality of subsection (1).

Statute

  1. Subject to the provisions of this Act, the Syndicate may, with the approval of the Chancellor, make provisions by the Statute on all or any of the following matters, namely: –

(a) the award of honorary degrees or any other honor;

(B) the introduction of fellowships, scholarships, awards and medals;

(C) the appointment, promotion, trimming, designation, powers, duties and conditions of work of the teachers and staff of the University;

(D) the formation of the authority of the University and the determination of its powers and functions;

(E) Establishment and maintenance of student accommodation;

(F) the method of recognizing a scholar as a university teacher;

(G) for the welfare of teachers and other employees of the University, as per Government rules, pension, joint insurance, welfare fund and provident fund;

(H) to introduce professorial chairs in honor of national and internationally renowned persons in the field of knowledge;

(I) to issue a diploma degree or certificate;

(J) Determination of the Teaching Authority;

(K) prescribing provisions for the creation, deletion or temporary suspension of the posts of teachers and researchers;

(L) establishing new faculties, departments or institutes, temporarily suspending, abolishing and establishing provision for education and research opportunities;

(E) determine the aims and objectives of the Academic Council;

(3) Ph.D. Determining the subject of research for a degree;

(O) determine the structure, capacity and functions of the faculty;

(T) forming an election board and determining its functions;

(L) to make provision for admission and examination in undergraduate and other courses in medical assistants and nursing;

(E) to make provisions for the formation of various committees; And

(d) any other matter which may or may not be determined by the Statute under this Act.

Ability to make rules

  1. (3) Subject to the provisions of this Act and the Statutes, rules may be made for all or any of the following matters, namely: –

(a) the admission and enrollment of students in the University;

(B) prescribing the syllabus and syllabus of the university’s degree, diploma and certificate;

(C) admission to a university degree, certificate or diploma course and participating in its various examinations, and the qualifications and conditions for obtaining its degree, certificate and diploma;

(D) the terms and conditions of residence of the students of the University;

(E) fees payable for admission to the syllabus and university examination, degree, certificate and diploma courses;

(F) the formation of various standing committees of the University and the determination of their powers and responsibilities;

(G) conducting the test; And

(H) such other matters as may be prescribed by this Act or the rules under the Statute.

(2) The Syndicate shall make rules on the recommendation of the Commission and with the approval of the Chancellor:

Provided that the rules may not be formulated without the recommendation of the Academic Council of the University on the following matters, namely: –

(a) the registration of the students at the University;

(B) prescribing curriculum and syllabus for all the degrees, diplomas and certificates given by the University;

(C) establishing a department;

(D) the uniformity of the tests conducted by the University and the Institute;

(E) the conditions of residence of the students in the student residence; And

(f) the eligibility and conditions for admission to a university degree, certificate or diploma course, to participate in its various examinations, and to receive its degree and diploma.

Ability to make regulations

  1. (3) The authorities and other bodies of the University may make rules consistent with these laws, statutes and rules for the following purposes, namely: –

(a) determining the number of members required to formulate the procedure and quorum to be followed in their meetings;

(B) to make provisions on all matters determined by the regulation in accordance with this Act, Statute or Rule; And

(c) the provision of such matters, except those concerned only with the authorities of the University, but not in this Act, Statute or Rule.

(2) The University may make rules for giving notice to the members of that authority or organization and to keep a record of the proceedings of the meeting on the date and considerations of each authority or institution.

(4) The Syndicate may, by the direction of this section, amend or repeal any regulation made under this section:

Provided that, if any authority or institution of the University is dissatisfied with such directive, the decision of the Chancellor shall be final.
