RE: FURTHER VETTING OF PROPERTY DOCUMENTS/PAPERS A/C. COMPANY 1.

We refer to your letter dated May 13, 2007 and November 25, 2007 and our opinion dated May 26, 2007 on the above subject.

Pursuant to our opinion, you have sent us the following documents/papers:

  • Bia-deeds: Deed of Sale No. 1915, 1916 and 1917 dated 15.04.84, Deed of Exchange No. 1313 dated 29.10.80, Deed of Partition No. 148 dated 11.01.83, Deed of Sale No. 6067 dated 14.08.73, Deed of Exchange No. 9474 dated 01.11.66, Deed of Heba Bill Ewaj No. 12312 dated 29.10.79, Deed of Sale No. 417 dated 11.01.60
  • Up to date ground rent receipt in the names of present owner.
  • Non-Encumbrance Certificate.

We have perused the above documents and our opinion is as follows:

Bia Deeds From the certified copy of bia of Deed of Sale No. 417 dated 11.01.60 it appears that, Ms. M sold land measuring 22.00 decimal under Mouza – Kunia in favour of Ms. N wife of Mr. K.

From the certified copy of bia Deed of Exchange No. 9474 dated 01.11.66 it appears that Mr. Muniruddin and Mr. Pir Box became owners of 70 decimal and 41 decimals of land respectively by way of exchange with one another under Mouza – Kunia. From the said deed of Exchange it also appears that they became owner of the respective land by way of purchase.

From the certified copy of bia Deed of Sale No. 6067 dated 14.08.73 it appears that Ms. Chiparun Nesa wife of Mr. K sold land measuring 22.00decimal under Mouza – Kunia in favour of Mr. Md. Amir Ali, son of Late Wahed Ali. From the said deed of sale it also appears that the seller became owner of the said land by way of purchase vide Deed of Sale no. 417 dated 11.01.60, which have not been referred to us.

From the certified copy of bia of Deed of Heba Bill Ewaj No. 12312 dated 29.10.79 it appears that Mr. Alim Dewan and Mr. Md. Abbas Uddin became owner of land measuring 100 ½ decimal under Mouza – Kunia by way of heba-bel-ewaz from their father Mr. Pir Box.

From the certified copy of Deed of Exchange No. 1313 dated 29.10.80 it appears that, Mr. Md. Amir Ali, son of Wahed Ali became owner of 15 ¾ decimal under Mouza – Kunia vide the said deed of Exchange with Mr. Wahed Ali.

From the certified copy of bia Deed of Partition No. 148 dated 11.01.83 it appears that Mr. Mosharraf Hossain Chowdhury, son of Late Nagar Ali became owner of land measuring 4.19 acres under Mouza – Kunia by way of partition with Mr. Abdul Malek, Md. Tahajuddin Miah and Ms. Rizea Khatoon

From the certified copy of bia Deed of Sale No. 1917 dated 15.04.84 it appears that Mr. Tota Miya, son of Late Dundu Miya sold land measuring 2 5/8 decimal under Mouza – Kunia in favour of Mr. Mr. Yaad Ali Miya, son of Late Md. Chan Miya. From the said deed of sale it also appears that the seller became owner of the said land by way of Deed of Exchange No. 609 dated 01.02.84, which have not been referred to us.

From the certified copy of bia Deed of Sale No. 1916 dated 15.04.84 it appears that Mr. Tota Miya, son of Late Dundu Miya sold land measuring 2 5/8 decimal under Mouza – Kunia in favour of Mr. Md. Harunur Rashid, son of Late Md. Chan Miya. From the said deed of sale it also appears that the seller became owner of the said land by way of Deed of Exchange No. 609 dated 01.02.84, which have not been referred to us.

From the certified copy of bia Deed of Sale No. 1915 dated 15.04.84 it appears that Mr. Tota Miya, son of Late Dundu Miya sold land measuring 2 5/8 decimal under Mouza – Kunia in favour of Mr. Md. Manik Miya, son of Late Alam Miya. From the said deed of sale it also appears that the seller became owner of the said land by way of Deed of Exchange No. 609 dated 01.02.84, which have not been referred to us.

Ground Rent Receipt : Ground rent payment receipt No. T 355909 and T355908 have been submitted, from which it appears that ground rent has been paid up to 1414 B. S. in the name of Company 1., land measuring 9 37/40 and 79 13/20 decimal.
Non-Encumbrance Certificate From the submitted Non-Encumbrance Certificate (NEC) for  1996 to 2007 with Govt. receipt No.57327 dated 25.09.2007 it appears that, the land measuring 82.30 decimals as described hereunder is unencumbered

Except Company 1. became owner of total land measuring 82.30 decimals from Mr. Shahid Ullah, son of Late Alhaj Abdul Baten and Mr. Md. Sarowar, son of Late Wahed Ali vide Deed of Sale No. 6179 dated 02.04.2002 and Deed of Sale No. 7176 dated 20.04.2003 respectively.

Subject to above mentioned observation, the aforesaid documents are in order.

We have been also been provided with some other papers/documents regarding which we have already provided our opinion to you vide our opinion dated May 26, 2007. Now we reiterate the same.

As per our opinion dated May 26, 2007 Municipal tax payment receipts (if applicable) have not been submitted to us.
