RE:     Information requested by Deputy Commissioner of Taxes regarding House Building Loan Account: Mr. X, a defaulter of Bank 1.

We refer to your letter no. ………………… dated 30 November 2006 and your subsequent fax dated 03 December 2006.

From your letter, it appears that the Deputy Commissioner of Taxes, Circle – 85, Zone – 8 vide letter no. ………………… dated 12.11.2006 requested Bank 1 (“the Bank”) to provide some information about the aforesaid account. As arrears of tax is due to the tax authority from Mr. X and as the tax authority requires the requested information to resolve the tax case against Mr. Chowdhury, the Deputy Commissioner of Tax has the power under section 143 of the Income Tax Ordinance 1984 to require the Bank to disclose the said information.

As such it is our opinion that the Bank should disclose the requested information and also all other relevant information related to the said account which are necessary to reveal the actual position of the account.
